I bought a BMW 318i ES 2004 reg from a private seller back in Feb this year- the car was advertised on Auto Trader and eBay indicating a mileage of 64K (whereas the actual as confirmed from a BMW garage later on turned out to be 111K). Also, the eBay ad mentioned 'HPI Clear' which is not the case.
I need advise from legal perspective regards the following:... Read more

hi,
I know there is lots of discussion on here about the 130 tdci....But I wanted to get more infromation on this engine in automatic form. Has anyone experience of running these to high miles? if so what were they like vs the manual. And also if anyone has remapped the automatic tdci and the experience with doing that.... Read more
My central locking is going beserk. All the doors lock and unlock repeatedly. Often it'll take a pause for a little while (minutes), then start again.
The radio has also lost power. These happened simultaneously.... Read more
Still no success with doors (or radio)
However, when I disconnect the passenger door wiring loom at the door-body connector, the doors stop going crazy, but they all lock and stay locked....

I bought a used Vauxhall Zafira (1999 V reg for £1220) from a trader on an ebay auction. The auction stated that the car "drives very well" and that returns were accepted and I bid and won on this basis. There was some minor cosmetic damage which I was happy to accept.
When I arrived to collect the car the drivers electric mirror wasn't working properly, which he "fixed" and the boot wouldn't close properly. At this point he revealed it had come from a local car auction and had been stored "for some time" (had I known this I may not have bought the car and certainly wouldn't have paid as much). I attempted to drive the vehicle home and discovered that when I took my foot off the accelerator the car stalled. This was in rush hour and was a frightening experience as I tried to return the car to the dealer.... Read more
The Act provides that wherever goods are bought they must “conform to contract”. This means that items sold through eBay by business sellers must be:
* of "satisfactory quality";
* "as described"; and
* "fit for purpose".
(For a private seller only "as described" applies).
Thus goods sold by business sellers must not be inherently faulty at the time of sale, must match any description given to them and, allowing for factors like price, they must be fit for their purpose, defect free, safe and durable.
Given the time since sale and the defects I think you have sufficient grounds to state that you had not accepted the car and can return it and claim a full refund.
Where the "price paid" issue comes into play is not so much on defects at time of sale but if a defect develops subsequently.
The Sale of Goods Act affords considerable protection on vehicles for up to six months after purchase with faults which develop assumed to be there at time of sale unless the dealer can show otherwise. The Act is however not blind to factors such as age, condition, value and price and had faults developed with this car (say) three months on the dealer could have reasonably argued that you might expect them to do so at this price level and refused to fund the fixing of them.
The problems with your car were clearly present at time of sale and in my opinion are sufficiently serious for you to reject the vehicle and get your money back.
The dealer sounds somewhat slippery and you may need legal help with this. If you think you will please contact me via asklucy@honestjohn.co.uk

Finally got to the bottom of the camshaft knocking problem , not the camshaft at all ,the dephaser was the problem,
never heard of it ? neither had i .it sounds like something from star wars .Its a toothed wheel that fits on the end of the camshaft ,and is driven by the cambelt.the wheel is filled with oil and as i understand it ,it works like a fluid flywheel ,it evens out the motion of the camshaft as the car starts ,anyway everything now runs as it should ,the total cost to repair was £450,better than the £600 to replace both camshafts,which probably wouldnt have sorted the problem . thankyou to everyone who read my original post ....
Hello,
My Focus ST-2 has been in the garage having its steering rack replaced and a battery drain issue investigated. Twice in the last four or so months the battery has been dead first thing in the morning.
Each time the AA have attended, jump started it and advised that the charging system and battery are fine and quite understandbly the dealer has been unable to replicate the fault.
However it is clear that there is an intermitent fault causing the battery to drain in 36 hours or so.
There are some systems that stay active for a while even after that car is locked, for instance the dash LCD's only go off after 15 minutes, though I think I would have noticed if the dash was still active when walking past the car.
My only other thought is whether this could happen if I had forgotten to lock the car on both occasions?
Any other ideas?
The car is keyless by the way.
Many thanks.... Read more
Hi There,
I'm really stuck with my car now, it is intermitently cutting out and not restarting. The problems leading to this are;
1. Noticed a rattle appear from the engine and took it to my local garage asking them to see what was wrong specifically 'is it the timing chain?'
2. Local garage says the vacuum pump and chain was worn so replaced this. Whilst doing this work they said the timing chains were all worn out.
3. Re-booked and replaced the timing chain with the local garage.
4. Car then started cutting out intermitently. Then not starting again. Idling too low.
5. Took it back to the garage and they couldnt see any faults.
6. Repeated steps 4 and 5 again.
7. Lost all patience and took it to the nissan main dealer. They have no idea what the fault is! The only way to check the work done on the timing chain is to pay another £300 labour charge.
What can I do? I just feel like I've been milked and left with a un-useable car. Any Advice is appreciated
Ps. if the garage had done thier job properly on point 1 and diagnosed the timing chain i would have sold it thousands of pounds ago! Read more
Hi...I erred on the side of caution, and had the cambelt on my Vauxall Movano 2001 van replaced. I have only started the van three times since replacement, first time it was fine, second time it was difficult but eventually started after charging the battery, third time it was fine but then stalled and would not start - just kept clicking - ran diagnostics which gave message: Faultcode 1808 Camshaft/Syncing speed sensor consistency.
Sounds like a timing issue - could this be related to the replacement of the cambelt?... Read more
