Happened to me. The insurance lot were not able to get the ones who hit us to admit liability for a long while. The premium went up but when the liability was admitted I got a refund, six months, dealing with insusance companies to me is like trying to pick eels up with your toes.

Hello Nurse, if the ticket states PARKING CHARGE NOTICE or CIVIL PARKING CHARGE or similar then it is a private company and should be ignored, no matter what they threaten. If it is a PENALTY CHARGE NOTICE issued by police or local authority then you need either appeal or pay up. Police or local authorities are not known for abusive staff who screech down the telephone at people so my guess is it is the usual money making parking scam. DO NOT RESPOND to any correspondence. If they telephone you ask them to hold on while you turn the gas off, and leave the telephone for 15 minutes, then hang up. They will eventually give up and hound some other poor soul. We own and run a small business centre and need some initial advice regarding who is liable for £600 of damage caused to a Tenant's customer's car last week.
The damage occurred when an un-secured entrance gate was blown into the customer's car. We have a disclaiming notice in the car park, and all the tenants are advised to secure the gate. None of the tenants are admitting opening the gate on that morning but we are waiting for cctv from a nearby business which could identify the tenant opening and not securing the gate.
The owner of the damaged car has written to us asking for our insurance details but we have not yet replied. In his letter he mentions that he saw the gate 'moving in the wind' yet he still entered the site. Also, no one witnessed the incident, although there is damage to the gate which will need attention as it is now difficult to lock-could we make a counter claim? And if so, against the car driver or the tenant?
If we identify who didn't secure the gate, are they liable or ourselves as owners? Read more

My thoughts would be ,that you are only liable if the person who's car was damaged can prove negligence on your part .
Was the gate in a state of disrepair ,we're the disclaimer notices clearly visible .
My thought would be that the claimant is responsible in part ,because he chose to drive through an unsecured gate .In addition the individual who left the gate unsecured could be considered negligent and liable .

I recently hit a parked car, leaving a dent in the door. When the owner got in touch, we agreed that I'd first try to get the repair work done privately as my insurance excess is very high. I found a replacement part from a breakers yard in near perfect condition (a couple of very small, barely noticeable dents which the bodyshop said would be easy to get out), but the owner is not happy and is now insisting that I pay for a brand new part. He is claiming that he does not know whether the used door will be safe.
The repair job will come to around £400 with the used part, as opposed to £800 for a new part. My excess is also £800. The car is 10 years old and probably not worth a lot more than that.... Read more
