Hi,
After returning home from a short break in August I received A NIP and S172 from Humberside police. The alleged offence occurred on a stretch of road my girlfriend and I had commuted back and forth along to the coast several times. We had shared the driving and neither of us could remember who was driving at the time, neither of us recall seeing a speed camera or seeing a flash. My girlfriend suggested we just put her name down and she take the points, but I really didn't want to give false information. I was going to request the photographic evidence, and noticed they had enclosed an FAQ which pointed out they didn't have to provide photographic evidence until the case went to court. Therefore, I sent them a letter saying I didn't know who was driving at the time of the alleged offence. They responded with a letter which stated I had requested photographic evidence (which I had not) and enclosed the photos. I was still unable to determine the driver. I then received another letter from them saying I had failed to respond to the NIP and S172. I replied with a copy of my initial letter pointing out I had responded, adding I had also now reviewed the photos and was still unable to determine who was driving, and that it was not a case of me refusing to provide the information, it was that I did not have the information to give.
I am now in receipt of a letter from them stating that in the circumstances enforcement action will continue as it is my responsibility as the registered keeper to identify the driver. I have failed to do this and the matter has been referred to the Magistrates' court.
I am currently awaiting Summons.
Whilst I am sure I'm in the right here, and have broken no law, I have zero legal experience and am now tasked with preparing a defence. Any help would be gratefully received.

Thanks for clearing that up Lucy. I am currently preparing my defence, assembling mobile phone records, bank statements, all the things I initially went through to try and determine who was driving at the time.
I really was unable to determine who was driving, I though it must have been myself as my partner often sat behind lorrys doing under the limit, then she said she remembered the sat nav beeping to say she had exceeded the limit, but she could not recall on which day this was. I then saw the bit on the s172 about it being and offence to provide a false statement, the maximum penalty being imprisonment....
I have just had a conversation with VW customer services about changing the Xenon headlights on my CC to left hand drive for when I visit the continent. Their reply was YES it can be done by a dealer, ask the dealer to call tech support if they don't know how to do it.
After calling 3 dealers, each one gives a different answer, look in the hand book, no it needs beam deflectors at £19.99 from us, leave the vehicle with us and we will waste your time while we check it out, cannot find out until we have the vehicle. Which would you choose?... Read more
To the OP sorry my mistake can't use masking on these lights.
I've been asked to fill in a driving license mandate from my employer so they can check through a third party my driving license status. Seems to be all the rage at the moment with employers and company drivers at the moment apparently..
Although i have no points on my license and nothing appears in the endorsment section on the paper part, i did have 2 speeding convictions in 1986 and 1989. (nothing since!)... Read more
It is usually for fleet operators and driver agencies who need to keep track of large numbers of employees. They obtain the info direct form the DVLA so points not applied show up and most of them run monitoring services which means new points and offences are notified as they are added.
In this case the OP's points are long spent and cannot be referred to but points count for insurance purposes for six years so it is possible that the licence could appear clean (as it is in terms of the penalty) once the points can legally be removed (after 4 years) but still invalidate a corporate insurance policy.
Hi, we purchased the above car from a small dealer approx 4 weeks ago for 14,500. We bought the car as a good model, some scratches and wear and tear from normal use, but reliable for its previous owner who was a friend of the dealer. We test drove it and it seemed fine. The dealer said the only comment from his friend was that it did need topping up with oil regularly, but on checking under the car there appeared to be no oil leaks. My husband said that he had read that these cars did guzzle oil so that was probably normal.
We have driven the car on a couple of uk holidays over the summer and have done about 1000 miles in the car, which had about 70,000 on the clock when purchased. To be on the safe side and to keep an eye on the oil usage in case there was a problem we have checked the oil twice in that time and both times the dipstick showed the oil almost on max. On holiday we did notice a funny ticking noise from the engine which we planned to get checked on our return.... Read more

Hi All,
My car has been making a strange noise for about the past 40,000 miles when releasing the clutch in Neutral. I have been told this is the clutch release bearing and is nothing to worry about (Which seems to be true as I have covered 40,000 miles with no problems since the noise began)... Read more
When it was in bits you should have had a look at the damaged DMF that way you would have known whether the garage was trying a fast one.As it is you do not know for certain if its ok and if it goes now causing catastrophic damage you will have no where to turn exept to pay out.Much as I dislike main dealers they are as a rule pretty honest when it comes to large items like this and they gave plenty of opportunity to come and look at the worn part.
I used Farecla G10 to remove light scratches of my black Mazda. The paintwork ended up with dull surface. Is there any bodyshop specialist can advise me how to rectify it, bringing the paintwork back to shinny, matching the rest of the panel surface? Many many thanks! Read more
Didn't use anything after Farecla G10 as this was the first time I used G10. Nothing shown on the G10 bottle let me think that I need to use other polishing product afterwards. Thanks for the advice. Used wax to buff the area again and it looks fine now.

Hi, Sorry I did,nt give all the details. The mileage on purchase 19700,but the service mileage was 20,500(in the service book),also on checking when I got the vehicle home I noticed the window washer bottle was empty so I refilled it only to find it all over the floor so I had to take it back to Bristol street motors to have it fixed.Thats the reason I,m a little suspicious about the serviceing....
