Hi There!
I wonder if there is someone out there who might know about bailiffs cashing in an order made by the court against a car dealer......I have obtained judgement against a car dealer with showroom, and know that once the deadline for payment is over he wont pay!, terefore I will need to resort to bailiffs at the end, but Im not sure if baillifs call at his show room can take away a car from him to sell since the car dealers dont register their stock into their name and can claim that whats on the premisses belongs to people who have left their cars there for sale.............any ideas! Thanks..John Read more

I found this site by putting the problem into a search engine. My car has had a bit of a hard time due to a mechanic, I use the title loosely, doing a service for the previous owner and connected the fuel lines back to front. It took a long time to find this problem so the car has had long periods of being cranked over, but once the lines were connected correctly, starting was fine. This was when I bought the car and a gradual difficulty in starting developed. The heater coil lights only come on very briefly and the engine cranks over for 5 to 10 seconds before starting. the longer I leave it, the worse it is. For example, I left the car for three days and it flattened the battery trying to start it . With a jump start it went and clouds, and I mean clouds, of black smoke belched out for a few seconds, impressing my neighbours enormously. Any ideas any one?
The first time I brimmed the tank there was a very strong smell of deisel and guessing that "meachanic" had been at the fuel pump I found the seal was'nt seated. I've been told air leaks are hard to find so I'll have to drive it every day.
I'm wondering if anyone can make some suggestions as I'm a bit stumped with this one. My daughter's corsa failed its mot on ' 3.7.A.5C rear brake application uneven'. The readings given were:

I have a citreon c5 diesel that's done 210k. Intermittently when I put my foot on the accelerator it feels that there is a blockage which restricts my acceleration and then it clears with a thick plume of black smoke coming out the back and I accelerate as normal. My regular garage found a couple of split pipes which they have replaced but it has not resolved it. They were unable to give a clear indication of what it might be or how much it might cost to put right. Any suggestions what the problem might be? Read more

Not serious in relation to many of the posts here - but annoying. I recently sold my car on ebay. The buyer paid cash, and I have received confirmation from the DVLA that I am no longer the registered owner.
HOWEVER, on checking the buyer's details after the sale, both the address and the trading name he gave appear to be bogus. (I have also had a note from ebay to say his acount has been suspended - though not through any action on my part). I do have a copy of a separate address from ebay (i.e. the winning buyer's address) which I guess must have been linked to whatever card was set up on the account.... Read more
I've had this. DVLA wrote to me asking to confirm buyers address. I never heard any more.

Bailiffs cannot seize anything on the property, firstly the items must belong to the person (not the household) owing the money, secondly if the said items are required for the persons employment they cannot take those either, i.e. if you're a computer programmer they cannot take you computers, a plumber - your tools etc.
Lastly without a court order to do so (which are very rare) a bailiff cannot enter your home by force, no foot in the door, no pushing the door open, he can enter through a door or window that has been left open. If he says otherwise - he is lying. Once he has entered the properly he can then reenter to seize goods - just don't ever let them in then they are practically powerless. They'll use all sorts of tricks, can I use your phone, loo etc. ignore them, just don't let them in (go outside to speak to them and close the door behind you.)
Finally always make a written offer of payment even if it's only £5 per week and keep a copy, they will almost certainly turn it down, if they do take you to court for an enforcement order, tell the judge your offer of payment was refused and present a copy of your offer. The judge will very likely be peeved at the bailiffs for turning down an offer of payment and will chuck the case out of his court, often quashing the debt as well, as a punishment to the bailiffs for being unreasonable.
