Hi I have a 2005 Nissan Xtrail where both wheel arches are beginning to rust. Nissan have rejected my warranty claim for repair. There appears to be a problem with earlier Xtrails but Nissan will not accept this. Has anyone got experience of appealing against a manufactures decision or too has suffered from rusty wheel arches. Yes the car has a full Nissan service history and has had its annual bodywork inspections each year.Dealer has confirmed that it has a 12 year anti corrosion warranty but my car has failed on their " screwdriver test" this they tell me is where a screwdriver can be pushed through the bodywork. After contacting two other independent body shops they tell me it's a common problem with Xtrails as water under the wheel arches penetrate between the two skins causing rust. But it's convincing Nissan that there is clearly a problem with the seal.

The car does NOT have a 12 year 'anti-corrosion' warranty. It HAD a 6 year 'anti-corrosion' warranty, and a 12 year 'anti-perforation' warranty.

Corrosion is minor surface rust - which is what you have....

Today my car have took to the garage and replace all new spring and damper. When I come collect and I look to my car looks ridiculous too high like 4x4. I said to the mechanic are you sure you put the right spring? he said it is correct spring and it will takes a month to drop to the normal level.

Is this true? The new spring is about 2.8cm high than before, my car is sport front is little bit lower than the normal Punto 1.9JTD Dynamic. I don't know if they have done wrong or whether I have to take my car back to the garage?... Read more

I don't have a lot of experience of this, but, yes, I would say so. It suggests to me the springs that have been fitted are out of spec or are at least different in spec from what was there before.

Last week I bought a 2009 BMW 1 series. At the weekend I noticed the nearside front door has had an extensive repair, not only that but the repair has been very badly done - The line of the repair is not straight, there is rippling where the filler is uneven, there are sanding and scoring marks and places where it's been badly rubbed down and finished and there is a paint run.

I bought it from a dealer and want to know if they have to accept any responsibility for selling a car with such a bad repair and if I have any rights to help with the cost of sorting it out (quoted £560 +vat by local body shop).??... Read more

Cheers Robjp, I appreciate that I have been lucky and had a good outcome, the guy who runs the dealership is an absolutely genuine and decent human being. Big lesson learned for me.

I also thought about whether I could just sell the car on in a few months, but there's now way I could do that to someone else, fortunately the dealer thinks the same way....

Just put my Fiesta in for MOT today. I got a call rom the garage saying the rod end passenger side had gone and needed replacing or else it was a fail. He said he'd do it today if he can get the part.

5 mins after the phone call I decided to go on the online mot history checker to see if it had been failed. But when I check it's been passed. There's no way he could have fixed it for then. So he has either passed it knowing he will fix it at some point today. Or it's passed and he's tried to charge me for some work he hasn't done.... Read more

Hi, I've a 55 plate Espace MKIV 2.2dci Auto, I'm having problems with the gearbox, when I start up the red box around park shows up as normal, but disappears after about 15 seconds unless a gear is selected before then & gearbox fault comes up on the dashboard. A friend in the local was telling me a woeful tale of overcharging and inflating bills by a local Mercedes dealer. He has an ML which was duly serviced by the local franchise. He is not hard up nor a skinflint, but he was surprised by the size of the bill plus one item that caught his attention. A significant amount on the bill was described as 'Manufacturer Recommended Emergency Kit'. Upon enquiry this transpired to be a bag containing 1 litre of 'special' engine oil, 1 litre of 'special' screenwash, a small spray can of 'special' lubricant and a pair of 'special' gloves. This had been deposited in the boot for future use. My friend then relocated it to the service desk and had the item removed from his bill, despite the overtures of the service operative that the kit was essential emergency supplies and he and Mercedes recommended every Mercedes carry one. Yeah right, there only concern is safety, yeah right. No though about charging over £40 for a bag of not very much then. My friend bid them a fond farewell never to darken their door again.

I must admit my previous VAG dealer never quite got the hang of removing the item for screenwash off my service bills. Despite the fact I always topped it up prior to going to the garage, and insisting this item was removed every time. I wonder what else they will come up with to inflate an already hefty bill. My indie does charge for screenwash, and for the sump washer.
But I don't care - I'm not going to complain.
He is extremely pedantic - and checks everthing very carefully, repairing minor faults before they cause a breakdown (such as a piece of corroded wiring). He always saves any unusual items to show me.

I'm not looking for the cheapest service, I'm looking for the most competent; so probably not anywhere with a glass palace attached.

Agreed SteVee, the cheapest isn't always the best nor the worst. A good indie will do what yours does and you respect that. Eng Andy is right about the 'premium' brands. They use the same oil and other consumables as other makes. The tools etc and the technicians are all about the same, so where do they get there pricing structure? It's all about brand snobbery. But I calculated that with approx 15-20 cars a day at 5 days per week and £6 a go for 'screenwash'. Over £400 per week or nearly £20k per annum for a bit of water with alcohol added. Not bad eh? Last month I got a parking ticket for the day when my wipers went whilst I was out, in the rain. As I was driving I pulled over into the car park I was next to and they've given me a ticket. I appealed explaining why I was there, that it was a practically empty car park and that I didn't leave the car. I had my 10 month old daughter in the car, I barely managed to even drive in to the car park and the RAC were on their way so I wouldn't be long so I just didn't even think to pay and display. There was a warden and he didn't say anything. I emailed them copies of the RAC report as proof.

They've replied today saying that if I had phoned them on the day using the phone number at the bottom of their sign, I would most probably have avoided the parking charge notice but as I didn't get out of the car in the rain and hail to find that phone number because I didn't even think of it in the short time that I was there, they won't cancel my charge. Apparently my options now are pay £60 or appeal to the Independent Appeals Service but if I do that I won't have the option to pay at the reduced rate if refused. Should I try or just suck it up and pay? Read more

Hello daveyjp, as far as I am aware there is only one Independent parking adjudicator system. My error for calling it a tribunal. All authorities, public or private, use the same process and same adjudicators throughout the country.

There are, for (bizarre) historic reasons, two appeal bodies for parking and other traffic matters enforced by local councils. One broadly deals with London, the other rest of England and Wales. Both are 'proper' tribunals, set up under specific laws and which came under the oversight of the former Council on Tribunals/Administrative Justice and Tribunals Council. ...

Just looking for some advice. I've test driven a used Seat Leon Estate. It's a great car and exactly what I'm looking for at a decent price. The only issue is that the dealer hasn't valetted the car yet and it smells strongly of smoke. They have assured me that they will clean it thoroughly and get rid of the smell but I'm not convinced. I think they'll probably make it smell ok by using air freshner, but the smell might come back, leaving me with a smelly car. The obvious answer is to get something else but there dont seem to be many of these around in my price range.... Read more

Motorpoint seem to have 20 of the exact car I want due in soon.

When I wanted a car of a type Motorpoint had, they'd 36 available - when I 'phoned them they said they could move any I'm interested in to my local branch. They accepted my assertion they wouldn't move 36 to near me and gave me the codes of those at my locality....

I am confused.

I have rung a couple of places for battery prices and some tell me that I will need to set up a 'trickle charge' to the leads as I change the battery as it will mess with the ECU, radio and clock settings - the clock and the radio I am fine with the ECU ???, and others tell me that it is a simple "on and off" swap.... Thank you to the people that have replied. I have actually just spoken to a Honda technician who has re affirmed what 'bolt' has just said. Negative off, positive off, change battery, positive on, negative on. Job done.
