Hi all it seems the in thing for chrismass presents this year was motorised scooters, you know the ones that are like kids scooters with a tiny little engine mounted on the back that sounds like an angry bee is after you.Well my question is does anybody know the legal ins and outs of kids say 10 years old roaring up and down the pavements on these things? I thought it was illegal to drive any type of petrol / diesel propelled vehicle without a license, being under age let alone on the pavement.

I recently bought an electric motor assisted push bike. No crash helmet, licence or insurance needed. But - to be legal - riders must be over 14yrs old, the power is limited to about 200watts, and the speed under power limited to 15mph. All other normal cycling laws apply.

Mmmm let's hope that doting parents have a sympathetic house insurer to cover the outing.

It is illegal for them to drive/ride according to our local police on the road/footpath.They are made for riding on a private drive or road.Even a private garden/ground`s not used by the public.At least that is what I was told by the police. Not on a public right of way

Unfortunately still not as clear cut as it should be.

Initially, these micro-scooters commonly called Gopeds, were on inception, thought not to be capable of being used on a road and hence not a mechanically propelled vehicle. Enter the abusers and use on the roads without documents and licensing. Call for action by Plod.

A Magistrates Court held that a petrol driven Goped was held to be a motor vehicle within the definition of Road Traffic Act 88.
This ruling was given a higher authority in the case Chief Constable of North Yorkshire (all rise please) v Michael Saddington 2001, which backed a Mags decision that one of the Gopeds uses would be some general use on the road and that users would therefore need a Driving Licence and Insurance. Unfortunately the ruling stopped there and the Court did not classify a Goped in any particular category. As a result of this, it is said that such vehicles cannot be registered so Excise is out, MOT and Crash Helmet.

As there is now an argument that it has been decreed a motor vehicle then Police Reform Act should kick in and if being ridden carelessly or off road in a manner likely to annoy, harrass etc then Plod should be able to seize.

This topic has appeared before and for reasons that should become obvious I can only repeat my previous post. I am a teacher and one of the things that you never get prepared for is attending funerals of students you teach. 4 so far in 15 years.All road traffic accidents. All avoidable. All tragedies. The most recent: a 16 year old who was 'having a go' on his mates goped. Slipped from the pavement over the kerb into the road. Ban them.

May I add to my learned friend DVD's submission regarding the status of motorised scooters, commonly known as "Go-Peds"

Recent case has provided precedent that it is an offence to use one of these devices on the pavement or road when blood acohol is in excess of the legal limit for motor vehicles. Defendant got two years ban and fine according to reports.

Unfortunately I am unable to provide the appropriate link, my grasshopper has a dicky knee.

There is a middle-aged woman round here, who I often see going to work on one, it is a bit more substantial than the go-peds you used to see, it has a seat on a vertical pole, and also a brake light, it also seems to have a better silencer, she wears a fluorescent bamd and a cycling helmet and uses the cycle paths. She is sensible, and I would have no complaints about people riding them the way I see her do, it's the young bafoons who buy them as glorified skateboards and go beserk on them, with straight through exhausts, it's the idiots as usual who who spoil it for everyone.

There was an article on Watchdog a few weeks before xmas about these scooters. Police down south had been threatening action against kids on scooters as they do require insurance.
