Two year gap between build and registration date - do I have any redress with the dealer?

What is the legal position regarding buying a used car with a 2009 registration, which turns out from the VIN number to have been built in 2007 but not put on the road until 2009? Is there any redress against the seller which is a dealer still trading?

I guess you could invoke the 2008 Consumer Protection Regulations, but as far as I know there have never been any successful civil cases against a dealer for this reason because, unless a car has been previously registered in another country, it is regarded as being 'new' on the date of first UK registration: www.honestjohn.co.uk/faq/consumer-rights/
