Hi Back Room,

I am selling my car to a dealer, it currently has a "personal" plate on it which I want to put "on retention" until I get a replacement.

I have the appropriate form from the DVLA for putting the reg on retention. They need the V5 with the form, and presumably they issue a new V5 with the old date-plate reg on it.

I was planning on handing the car over to the dealer (in exchange for a bank draft) tomorrow, but having read the DVLA form there are dire warnings that if the car is sold before I get a new V5 with the original date-plate on it, the rights to the personal plate pass to the new keeper.

So, backroomers, do I

... wait until I get the new V5 before handing the car over to the dealer (which could be weeks)
... hand the car over to the dealer, post the V5 and retention form to the DVLA, presumably I will get the V5 later and will have to take it down to the dealer to do the change of registered keeper (red section of V5) thing then? Isn't this a risk for the dealer that I never come back with the V5? How does he sell the car in the meantime?
... hand over the car to the dealer, do the red section of the V5 now, and hope that the dealer doesn't sell the right to my plate to the new owner? There *will* be a comment on the receipt that the plate is not being transferred to the dealer.

Shurely there isn't this faff on every time someone wants to sell a car with a personal plate to someone else?

If it matters, this isn't a manufacturer's main dealer, it's a local "specialist" dealer.

I think that speaks for itself.As with any sale right of ownership.from point of sale to dealer or private it is owned by them.would wait for V5 as they are entitled to sell the car on with personal plate.adding more to price.not sure if a comment on receipt could or will count as the car needs to be registered with a new No.I expect others will know better but I wouldn`t sell untill I got the V5

I looked into this a while ago,and went with putting the plate on retention, then selling the car. It seems there is no way to do a transfer and a sale at the same time. In my experience the V5 usually take a couple of weeks after the the local DVLA office has done it's bit, which takes about 10 days.

I thought there must be a way round this, but it appears not. I'm sure I've seen people drive their part-ex in with a PP, and drive away their new car with the same plate, but maybe not.

If you're trusting, you can hope that the new owner will allow you to transfer the plate off his new car (your old one), but there's no guarantee, plus the DVLA might want to inspect it, plus you'll have to trust him to swap the plates at the appropriate time and send back the old tax disc. Either that, or the dealer does it, but again, he'll be without the V5 and unable to sell the car.

Looks like you've learnt the hard way (as I had to) and make sure next time you put it on retention 6 weeks before a possible sale. Welcome to the world of inefficient, beaurocratic, paper-pushing government agencies. You can't even phone your local DVLA office to see how it's going, you have to call DVLA in swansea, and they call the local office and get them to call you back sometime later that day (if you're lucky). Now that's progress for you!

Photocopy the current V5, then visit your DVLA local office with the original V5 and tax disc. They will transfer the number over the counter and issue a new tax disc.

Take the car, with new plates and tax disc to the dealer. Offer him photocopy of old V5 and promise to send replacement V5 as soon as it arrives from DVLA.

He can still sell on the car and enter new customer details on your replacement V5 when it arrives.

My partner recently took her private plate off and the new V5 came back within a week, shortly followed by the retention certificate, it seems DVLA have it sorted these days.

Thanks all - the dealer took the car and paid up, he took a copy of the V5 and I've sent the original off to DVLA to get the plate put on retention. When I get the new V5 I'll take it down to the dealer.

He's obviously a more trusting person than I am... he's got the car, I've got the money, but he's still not the registered keeper on the V5...

The dealer shouldn't be worried. Ownership of the car is titled to him by the receipt you would have given him when he bought the car. The V5 does not prove ownership, only tells the powers that be who is its registered keeper.

When you get the new V5 he will send off the red section at the bottom telling the DVLA that the car has been sold to a dealer and will keep the blue and green parts until he sells the car.
