I am one of the expanding number of non locals to be flashed doing over 30mph on the dual carriageway that is known as Maybray Kingway...

I had never driven on that road before, and I am SO p***ed off as all the subliminal signs, (built like a motorway) plus the fact that all the single built up roads to that spot are posted as 40's, I feel like going in front of the beak, and trying to see if he/she would see reason.

I saw the camera and was dawdling, and was v surprised when it flashed, but even more so to get a NIP for 35.

Has anyone risked going and telling the magistrate the obvious, or have we all bottled and taken the Speed awareness course.

There was a post for a petition a while back, did anything happen, it doesn't seem to have had any effect.

New ACPO guidelines say "It means drivers can pay to do a speed awareness course instead, if caught at up to 10% above the limit plus 9mph."

So it may be a bit borderline for you but a course ins't a conviction and will keep your licence "clean".

Drive and park legally and you have nothing to worry about.

Drive and park outside the law then pay your fine and take the points.

If you are not prepared for that sell the car.

Is the OP seriously suggesting that he should stand before the magistrates and ask that they do not convict him for speeding on the grounds that, in his opinion, the road in question should not be subject to a 30mph limit? Or is unconvincingly signed?

I mean, how much of a chance does anyone think he's got?

I am suggesting that it won't go to court and he will be offered a Speed Awareness Course, which he should take. Not necessary to sell the car despite what some say!

I've 'walked through' this on streetview. The road concerned is a short section of rebuilt grade separated carriageway linking two lengths of thirties by-pass with houses on both sides. The 30 limit is posted where it starts and there are speed camera signs with reminders of the limit.

We've all done it in those circs either by choice or lack of observation. Neither justify 'going to trial'.

The beak will not be sympathetic but will resent the court's time being used for what can only be faux mitigation for what should have been a guilty plea.

The best option for the OP is a course followed by accepting the fixed penalty & points. The court will impose a bigger fine with costs on top

SFAIK a course is instead of penalty and points. One gets one or the other, not both. The speed quoted suggests that a course will be offered.

I meant that OP's choices were (1) course at cost of £60+ and no points (2) FP fine & points and (3) the v costly option of court.

Hello Td5alive, sometimes we just find ourselves in a situation with no 'wiggle room' and this is one. My feeling is you are more angry with yourself for getting caught. At least if you are offered a course you miss the points and the resultant hike in your insurance so you are ahead on that score. One thing is for sure, you will probably not get caught so easily again so it's £60 for a salutory lesson in the harshness of the system if you step over the line. If you get the offer of a course, it might well be worth the trouble. SWMBO slipped up when a camera caught her at 60 in a 50. Most unusual for her. However, I got a bit of backlash as she claimed I told her the average speed cameras at and near the Cat and Fiddle (between Macclesfield and Buxton) were kaput. But i didn't say the ordinary ones were out of action:) Since the course she has admitted there were a number of tips of which she was previously unaware, and she thought the delivery was really good.

That section of road has street lamps less than 183 metres apart ( 200 ft ) so by default is a 30 limit unless signposted otherwise. There must be terminal 30 Signs on entering the section but repeaters are not required or in fact allowed.

You do not appear to have any defence and taking it to court will through away the chance of a SAC as the courts an not offer these. Regards Peter

Thank you all for your replies, some a little harsh considering the situation. I don't believe there's a policeman alive who would have even cautioned me where I was doing 35. I do not speed, I have a vehicle that's not conducive to it.

Yes, I'm angry for being caught, but angry not only with myself as it was one of the very dark wet,rainy days, and I missed the one repeater 30 camera sign in the dark of the bridge. I'm angry with the cynical placement and use of cameras in that position where they must know that many drivers will be conned into driving over 30.

If they really wanted people to go at 30 they should put large double 30 signs up each side where the dual carriageway starts. The stats on that camera rather show that it catches many more than it would if the signs were more user friendly, and I can bet they are all from non Hampshire / Southampton drivers.

Yes I know that street lights usually mean there's a 30 limit, but I come from London where every road has street lights, 30,40, 50 and even 60 limits are all lit. Even coming along the M27 its all streetlights around Chichester and a 50. The built up single roads 2 miles prior to this has driveways coming out onto it and is posted as a 40 and I was doing under 30 along it.

I know I have little choice but it's leaving a pretty bitter taste.

I think the only harshness in some of the replies (perhaps mine included) was a response to this rather provocative line in your original post:

Taken at face value, it suggests that taking an aggressive line in a magistrate's court was a sensible option and that anyone who thought otherwise was "bottling it".

I quite agree that there are some speed camera sitings which make a joke out of their supposed role as "safety cameras" and I quite understand that in this case it was easy to make a mistake - we've all been there.

I was once flashed in a town in Kent I've never been to before on a dark wet night, but got no ticket, as presumably there was no recording at that time in that particular camera. A piece of undeserved good fortune.

That's contradicting yourself. You admit doing 35 in a 30 but don't speed, how does that work?

I don't speed...take a look at google earth of this road, road signs, and any experienced driver could easily get sucked in to thinking it's at least a 40. I thought it was and was only doing 35 in what I thought WAS a 40.

I don't speed either - doing 38 in what I thought was a 40 limit and got a ticket as it turned out to be a 30 - we all misidentify the speed limit from time to time so take it on the chin and remember to be EVEN more observant in future.

"I thought the limit was a 40 your honour" is not a good defence. Signs will be out, you just did not see them or assumned incorrectly.

Seems like a case of Humpty Dumpty.

Most people would say that "I don't speed" means "I don't exceed the speed limit".

In your case "I don't speed" apparently means "If I exceed the speed limit it is because I failed to spot the signs, so that doesn't count as speeding."

Time for a reality check, methinks.
