hi i bought a car from a well known dealer. i got the car mid feb 2010. i paid a fair price for it.
2 days ago on my way home form work the engine raced and when i stopped it was revving it nuts off hitting limiter and smoking like a chimney. i managed to stall it as i could not shut it down as i had taken key out and it was still revving. its a 1.9 tid saab 93 2007 .
its gone into a garage to get looked and its come back as the turbo seals were damaged and its sucked up oil and ran on it own oil. now am i correct in thinking the sales of good acts come into affect as turbo seals were faulty before i got the car and that it would not wear out within 4 months? i have extended warranty but im only trying to gain knowledge now so i know where i stand . if warranty pay out then in all fairness thats ok. but if they dont i`m stuck with a large finance on the car and a hefty bill for work and a car that does not work. the damage is complete engine failure.
any help fomr anyone would help me alot.

Can you detail the mileage and the estimated costs of repair? It would also be useful to know who provided the warranty.

mileage is just over 44k but the cost to strip the engine to allow assesor to make a report is about £415.00 which i had to pay. the assesor is there now as i type doing a report but he does not tell the garage anything and reports back to the warranty dept. the damage is as follows.

turbo siezed

one melted piston.

i have never raced the car not driven it hard as i am very strict on my mpg and at time i was doing tops about 40 mph when the problems began.

i need help and lots. i have just had garage call me to say warranty declined the repairs as they cant find where the fault came from ie. where it originated.

now what the heck do i do? i have contacted the finance as car is hp plan. now what happens and what do i do.

Hi an interesting point that you mention is that you have finance on the car.

If the finance is conventional hire purchase , rather than a personal loan, you may be able to get the finance company involved.The reason being that the finance company technically own the car,where hire purchase is involved , and are reponsible for its quality.Check whether you have a personal loan or a hire purchase agreement .

Another issue that Ive recently been involved in, to beware of. Is that you say that you have the car in a garage being looked at .Presumably not the garage you bought it from. If you allow the garage who now have the car to do any work on it.Without the permission of the garage who sold it.You will not be able to claim any of the costs from the garage who sold it to you.Even where a warranty company is involved its important that you have the permission in writing of the selling dealer,before any investigation work is carried out.

If the warranty company wont pay,you wont be able to use the sale of goods act to recover the cost of repairs if youve not consulted the selling dealer before working on the car.

I'd be surprised if the warranty did not agree to stand the repair. It cannot claim the fault was there at purchase after this length of time however you do not mention the mileage (which may be high, therefore they can claim wear & tear) & you don't mention the service history.

If the warranty will not cover it, get an estimate from the garage then ask the supplying dealer (under the 6 month rule) if they want to a/ fix it themselves or b/ contribute significantly to the estimate. Either way you are responsible for paying for the diagnostics as it's your car.

Ok, I'm confused?

I thought the garage had said that the seals were damaged. What has changed?

I would ask for a copy of the engineers report.

If the parts that have failed are covered, the warranty co would need to establish why they were not paying.

They warranty co should have a complaints procedure or failing that try Motor Codes (if the warranty co is a member)

You need to obtain a copy of your warranty and also of the engineers report to try and establish that the warranty covers the vehicle. Some are very limited - some are very good.

If you can supply me with both I will be happy to read through them and establish your prospects for success.

hi lucy. just a quick one. im 800 out of pocket now at this stage but i got what i wanted. warranty are now paying for work. i since found out that the car has not been right and running on 3 cylinders only.

so now i got the results i wanted and also they have agreed to pay me back my money i have spent.

RESULT!

well warranty have agreed to repair car but its now been 5 weeks since it went bang and 3 weeks at agarage to replace engine. they still cant give me a def time when its going to be finished. i have spent to this day £850.00 of my own money and have now requested a cheque from warranty.

where do i stand in seeking further compensation etc and heres the twist in the story...

i heard from warranty that there had been a fire within a part but the part which is a regenration ( cat filter box on the exhaust system)for emissions does set on fire inside the part and then they said they were waiting for a new one from saab. that was the 15.7.2010

i have done some research and i believe the car had set fire underneath as where this filter is under the car if oil or any combustble things grass near would catch alight as the filter box ( like a catalytic converter filter) burns the soot and carbon inside. now i have my reasons to think the car has been damaged to fire underneathd as they also said they had to order a exhaust heatshield. now why would one need to replace the heatshield if there was no fire?

rung them today and they now said they not putting new one in but a second hand part which they should get this saturday and hopefully the car ready by next tues/weds.

how do i go about getting info from garage without them been so tight lipped. when i last spoke to them a couple of weeks ago they rung the warranty and they said nothing to me. do i mention solicitors to garage and state they need to tell me exactly whats happening??

im ready to go to the garage itself and demand i see my car and im really now at the stage for solicitors to get involved as since day one when they started repair the garage nor warranty have rung me to keep me informed on whats happening or of any problems etc. the have been total a**eholes and im fed up.

You need to seek an urgent update from all parties. Tell them if you fail to get a satisfactory response you will issue proceedings which will include a loss of use claim at £10 a day.
