So I was a passenger in my daughters car. She came to an empty roundabout (a very small one with five or six exits surrounded by residential roads). Somehow she didn't pick up on the roundabout in the dark, basically turned right without going around it. As she did so a van came out of the road she was heading towards, they passed us with more then enough space. I made her pull up further down the road to tell her what she did, that is when I noticed the van had went around the roundabout and back down the same road as us. My gut feeling says it was a police van due to blacked out side windows and the fact they drove back around. Would anybody know the severity of this type of offense and likely punishment if any? She was not speeding just made a silly mistake. Also if this was a company car, when should she expect to hear from police?

If it were a police van they would have stopped your daughter there and then to deal with her dangerous driving.

1st thing i would say is the roundabout couldnt have been that small if it had 5 or 6 exits and enough space for your daughter to pass a van going the right way?. But even so, a 'mini roundabout' has to be driven round exactly the sam way as a normal roundabout, unless the size of the vehicle prevents this from being done safely. Not sure what the penalty would be for what your daughter did, but i wouldnt imagine it would be very severe. At worst, a couple of points and a fine, at best, a chat from a police officer. If it was a company vehicle and the company got wind of what hapened?, hard to say what they would do as it would depend on the individual company, also whether or not it had some sort of signwriting on it (if this was the case they might take a more hard line with your daughter as she is representing the public's image of them), which, being a bmw convertible, i doubt. With regards to the van, i agree with diesel boy, no way was it police or they would have pulled her over. The driver may simply have been trying to find somewhere, it could just be coincidence that he went round again. On the other hand, there may be a dash cam involved, the driver may have come round again because he felt he didnt get your daughters number plate on the roundabout and intends to hand th footage over to the police. If that is the case, she will just have to deal with the consequences.

Well i doubt she's the first person to make such a mistake, especially in the dark, and she won't be the last, there's a world of difference between making a pigs ear of something and deliberately going the wrong way round a roundabout in order to overtake...and yes now and again every lorry driver will have seen cars and vans do exactly that o a roundabout or laid out junctions in order to overtake.

If the van had been a police vehicle i suspect they would have pulled you up immediately if they were going to take action though an attitude test pass would probably have seen a chat only given the circs, i've seen marked police vehicles ignore far worse many times and do far worse themselves without a blue light or siren to be seen/heard.

Its entirely possible the van driver was as confused about the roundabout as your daughter, her appearing from another direction to the one expected might have helped a bit there, no harm done no nuns carrying baskets of kittens were knocked flying, i wouldn't worry about it for another second.

I agree with the previous posts if it was the police they would have stopped, they don't drive past then send you a letter, thats only for static cameras.

There is also the chance if it was the police that there is nothing they could do anyway because they know the roundabout is not properly marked with the correct signage, advance warning sign, lighting or road marking. They don't bring charges where there is and easy escape. One way or the other you are in the clear.

Yep she has commited a moving traffic offence so would be 3 points & £100 fine. Contravention of The Traffic Signs Regulations and General Directions 1994.

Seems like she has got away with anyway so no bother. Maybe just a lesson that she might not be so lucky next time

Are there keep left bollards on the approach to the roundabout?

Does the roundabout have a raised kerb on its perimeter?

If the van was able to go round the roundabout, it seems to be something bigger than a mini roundabout.

Perhaps a link to Google streetview or something similar would give us more information.

There are keep left signs on the roundabout, however it's virtually side on to the road we came out of and only becomes slightly visible at the last second. They're flat bollards, not the usual colour with a rectangle shape to them. Yes it has a raise on it, maybe I defined the roundabout wrongly? My daughter confirmed it was 5 exits, all roads attached are single lanes. But the roundabout itself is tiny in comparison to the actually surface size of the road. I'm going to check google maps and post the link when my daughter gets back to me as she would be more knowledgeable of the area.

I very rarely see anyone use a mini roundabout (pancake in middle of junction) properly due to not being able to swing in one go (depending how large it is) as they normally hold the traffic up while trying.

personnally I treat the very small ones like cross roads, and most as you turn right can get a motor coming from the right go past as you turn no problem, and hardly anyone treats a mini roundabout as a roundabout. most are going too fast, whats known as a waste of space imo

So your daughter ignored a keep left bollard and you say she's knowledgeable of the area. Do you think she may perform this manoeuvre as a matter of course?

There's a roundabout near me where much of traffic take the third exit into housing estate. It became common for drivers to turn right without bothering to go round the roundabout, until the police had a field day there!

Approaching the white mini dot (sign 1003.4 TSigns Gen Directions 2002 (under review) will be a blue rbt sign ( sign611.1 TSGD)

The significance of this sign is: -

611.1

(a)A vehicle entering the junction must give priority to vehicles coming from the right at the transverse road marking shown in diagram 1003.3 associated with the sign or, if the marking is not for the time being visible, at the junction; and

(b)a vehicle proceeding through the junction must keep to the left of the white circle at the centre of the marking shown in diagram 1003.4, unless the size of the vehicle or the layout of the junction makes it impracticable to do so; and

(c)no vehicle shall proceed past the marking shown in diagram 1003.4 in a manner or at a time likely—

(i)to endanger any person, or

(ii)to cause the driver of another vehicle to change its speed or course in order to avoid an accident.

Sign 611 is a sign that Sect 36, RTA 88 applies so that disobeyance of above requirements makes it an offence not to obey a traffic sign.(Direction 10 (1) TSGD)

For this offence under Schedule 1 Road Traffic Offenders Act 1988 a Notice of Intended Prosecution must be served with 15 days (14 + day of offence)for a successful prosecution to be successful.

There are a lot of roundabouts like that in my area where you cannot keep left due to the size of junction

There still is not enough police about to enforce any laws anyway, which is about time was rectified imo. have to see what next government does???
