My car was rear-ended in a snow storm boxing day ,they other party as admited liability

I have informed my insurers,giving all details of witnesses other party details and names and adresses + i took pictures. My car was taken away today by "Just car Clinic" to be repaired. Now according to them my insurers have informed them that I am to pay a £520 excess and claim it back from the 3rd party insurers.

Now dont get me wrong but i thought when i paid my fully comp insurance and i get hit , i am the victim the other partys insurance should pay this but why do i have to find all this money baering in mind its money i dont have so im asking what do i do without paying them a penny ??

When the works done and the cars ready I was told i can ask for a "Pro Forma Invoice" Please if there is any 1 out there can give me the best advice ever i would be eternaly geartful because when my cars ready i just dont know where im going to get £520 to pay the excess .... Thanks dl56uk

Sorry to hear of your woes.

AFAIK it's fairly standard procedure for the insured person to fork out the excess and claim it back. In theory you could get the money back quickly, but in practice...

Taking out a loan might be the way forward; whether you can claim interest on the amount borrowed from the other insurers I don't know.

Perhaps someone who's been involved in this sort of situation can help.

It is because YOU are making a claim through YOUR insurance, hence you are liable for the excess as agreed when you took the policy out. The fact that it is someone else's fault is irrelevant at this stage as not only do you need to claim it back, but your insurers also need to claim their costs back too and whilst this is all ongoing your no claims bonus will be up in the air.

If you had let the third party insurers take charge and repair the car themselves, your insurance would not need to be involved and you would not have had to pay out your excess.

Insurance companies are usually only too pleased to sort out third party (your) damage when their own client as admitted liability to them.

Keeps their costs right down when the accident management crew are kept out of the loop, faster and easier for you, no excess problems and no danger of a disputed credit hire bill coming back to haunt you, you only need inform your insurer for their records though they will try to get you to go with an accident management claims crew, its to their benefit not yours.

The only downside is that you may well only get a standard little group A courtesy car for the few days yours is off the road instead of something more desirable and well overpriced for longer while they waste as much time as possible...which we all end up paying for in increased premiums.

As others say, if you go down road of letting your own insurers sort out the claim then you pay the contractual excess no later than when you collect the vehicle from repair. That t hen becomes a loss recoverable from the 'other side'.

You say the other party has admitted laibility which is good but no guarantee they won't resile from that when full impact of premium/NCB etc kick in. A rear ending should be straightforward but (see the Audi thread below) some drivers still struggle to comprehend their liability in their specific ircumstanes.

As others say you're probably going to need to borrow to pay the excess. You are of course not alone in having such a need. Does the repairer or your insurer have any credit or instalment faclility to meet such circumstances?

Do you have contact details for the other insurance company? Including the policy number?

If so, it is worth a call direct to them and explain the situation. Explain that otherwise you will have to go to a claims assistance company and they will help you obtain a temporary car and then pursue your claim.

I would expect the third party insurer to find a way to help you, and I expect that they will do it quickly.

Make sure you keep records of names and tiems of your conversations.

If you do nto have the approriate details, then ask the other person to let you have them.
