Local Council - Can do or Can't do ??? - autumnboy

Not sure if this the correct place to ask, but it is motoring related.


A local school in a County Council area has asked its staff to produce and change the following.

1) Produce driving licenses from its staff to show its valid and have no more than 9 points.

2) Produce a valid MOT certificate for that persons vehicle if its required.

3) Produce and change that persons vehicle insurance for
business use, although its covered for use 'to and from their place of work'.

The above applies to staff no matter whether they park their vehicle on the Queens Highway alongside the school grounds or in its car park. Even if that person only uses its vehicle once or twice a month.

The staff has already had their personal background checked by Police and attended First Aid courses for the safety of its pupils.

Has the County Council or its Headmaster the right to ask of this or is it another new
bureaucratic requirement of the day.

If all the staff are doing is travelling to work by driving themselves, then I can't see the reason for it. And what about those that walk, cycle, use public transport or get a lift of their spouse?

If they have to use their car in connection with the school's business, then yes, to ensure they're whiter than white.

But what duties do teachers have that require them to have a car available?

Do teachers still ferry pupils about for inter-school sports and the like? Don't schools have approved suppliers of transport for such occasions, who will have suitable vehicles and vetted drivers?

Seems to me advice from their Union/Professional Association is needed.

Been away last few days.

At my infant/junior school its school policy, if a pupil has to go home for what ever reason. The parents are contacted to collect their child.

At present without mentioning school name or the staff in question. There are members who have no transport and as said earlier park their cars outside on the road nearby and none drive any vehicle belonging to the school or council or use their own cars in any connection with the school or council.

From what can be understood it stems from a case where someone who had a accident in a vehicle belonging to a council and that council is being sued for liable.

Currently in the next few days, the staff will be asked to sign some document and produce as what is required and all will refuse to comply for reasons given above.

Quite right too! Oppressive heavy hand of misguided admin! I had to produce my insurance to my employer but that was because I was claiming motor-mileage allowance for some duty travel commected with my employment. No problem with that.

Yes if transport is required for whatever, football etc for the pupils, then they use approved hired transport Taxi or Minibus via the council.

Section D - Declaration

I certify that the information, which I have provided is correct and I understand that failure to provide accurate information may lead to disciplinary action being taken.

This small group of staff at this school are refusing to produce any such information as requested, but they have no union for support, so we shall see what happens next.

Well there is a union that represents school staff, perhaps they have chosen, in the past, not to join it. A quick trip to a solicitor for a review of the document might be worth the cost, split between the involved staff?

Teachers have always refuted the envious claims of others that they have short working days and long holidays by saying that they use a lot of the time for preparation, marking, etc..

If they take work home in their cars that's business use.

They need to file a grievance with their employer and run it through the process.

Unless they drive their employer's vehicles, vehicles hired by their employer or use their own vehicle for their employment the policy cannot be imposed nor can they make failure to comply with the imposed terms subject to disciplinary action.

In my experience, teachers can be champion whingers - you only need to see their outpourings at NUT conferences. Is it really the end of the world to show your employer that your car is road legal just in case, once a year, you have to use it on works business? If they need to pay extra for business use then I don't see why the employer shouldn't pay ( for employer read us the taxpayer).

And if the employer is being sued it's again us, the taxpayer, that picks up the bill.

Either way, who'd be a taxpayer.

Ok enough of harping about teachers.

The question is related to Lunchtime supervisors or better known as dinner ladies, who as its said do not use their cars in connection with there jobs or get fuel supplements and only work an hour or so a day.

my wife is a teacher. when working full time in Herts, was required to do the above, (see original posting)

when working full time in Bucks the same again...

now with family she works as a supply teacher so doesn't need to produce full documents...(oxfordshire)

THE REASON THEY ASK FOR :- licence /MOT /TAX insurance is:-

teachers might/can be asked to take children to hospital. ie if a child falls during PE or play time, and the local Ambulance in rush hour might well take over 30mins....its faster for the school first aiders (my wife in the above cases) to take the child to A&E whilst the school staff contact the parents and inform them...

hence you wouldn't want your child to be rushed to hospital in an untaxed.unsured, unmot'd etc etc car.

just like at most companies now, when you start you get asked to provide driving records/details so they can be copied and names added to fleet cars
