Fit for sale? 5 Feb 2007 (Forum)
I have contacted the dealer who said "bring it in and we'll look at it"...... which I will do over the weekend. Please can I have some advice on my consumer rights.... Is the dealer liable? Is it wear and tear? Can I expect a heated debate? If it comes to it can I threaten a small claims court? None of these issues may arise if the dealer (as I hope) simply complies and sorts it for me but advice would be appreciated. -

Yes that's right, and Isuzu Rodeo. A mate of mine bought one a couple of weeks ago from a dealer in surrey who specialises in US spec left hand drive vehicles. It is a 4x4, and looks just like a Vauxhall Frontera. -

I asked Honest John who I greatly respect and he very kindly responded to say that the dealer can cancel the contract on the basis of the contract being 'unfair'. This makes me think further. According the the Consumer Direct website ... Terms in consumer contracts that set the price or define the product or service being supplied are 'core terms' of the contract and are exempt from the test of fairness as long as they meet the plain language requirement. -
Ford Focus Estate - Problem with a used car - CRA 28 Jul 2018 (Forum)
I havent took it to a garage yet. But if I do and face a huge bill what are my options. Can I use the 'Consumer Rights Act 2015' 30 day period, I also paid via debit not credit card (if that makes any difference). If I understand the CRA correctly I can either return the car and ask for a full refund or ask them to repair the car. -

Although it was purchased with a new MOT, the car failed another MOT within 1 week of purchase. I tried ringing the seller to no avail, so sent a strong email stating my views regarding consumer rights, DVSA, consumer credit act , county courts, trading standards, breach of contract and mis-selling of goods. I then contacted my credit card provider who suspended the payment. In my email I gave the seller 48 hours to refund my money and collect their car or I would act upon my above stated views. -

I’ve pointed out to them that traders have a responsibility of care under the Consumer Rights Act 2015 and they’re liable for the costs. The car is literally in the middle of their garage and hasn’t moved since the service. Any advice? -

I did take out an AutoCare warranty (yes, I know not much love for those) but I presuming under my consumer rights I can just take the car back to the dealer and insist/politely request they investigate and rectify the faults that are showing as presumably these faults wouldn't have just appeared this week. -

This one is liable for the oil spill so you can tell them that if they don't pay for the clean-up you will get it done elsewhere and will sue them for it. When I checked the oil level today it was about 3mm above minimum, but provided it doesn't go Below minimum then no damage would occur - is this right ? On this webpage it gives some figues for engine oil consumption but when they say NEW engines today use less than 0.5 quart of oil in 3000 miles this wouldn't apply in my case http://www.aa1car.com/library/oil_consumption.htm -

The image has only been reinforced subsequently and, although I cannot deny the virtues of the range, as a current M-B and Golf owner I wouldn't dream of buying one now. Just goes to show how irrational the consumer can be, I guess. -

Alfa Romeo jts - Engine Failure on approved car 27 Jul 2010 (Forum)
The fault is defiantly internal, and the bill is already fairly substantial just finding out what is wrong with it :( I'm worried about the warranty covering any repairs on the car (I dont trust it for some reason - and I'm sure they will try and wiggle their way out of paying.) Would i have any case against the dealer within consumer rights / sale of goods act - should it get that far? Any advise would be gratefully received. KA. -

Even after complaining to the groups MD almost a year ago the dealer still does not seem to think i deserve either to be treated fairly or expect a reasonable amount of care. As consumers we have rights under the sale of goods acts but getting them enforced is all down to us. It says above this box "no naming and shaming" - ok, that's the rules here but I wish someone had told me about my dealer before I bought my car - and as for the manufacturer caring, just don't expect that - get ready to be told that your complaints is with the dealer who sold the car, not the maker. -
Drifting Fiat Punto (follow-up) 14 Feb 2002 (Forum)
She found that when she was toodling down the M5 at about 60 or 70 mph the car would occasionally drift to left or right for no apparant reason. A bit like being blown off course in a strong wind but it happens on windless days. A couple of you kindly suggested possible reasons for this and indicated a trip to the dealer. -

A fair few posters on this forum have appeared to be suffering from what has recently been coined 'choice anxiety'. More and more people are now stressing over whether they have made the 'right' decision, and mostly it's not concerned with life-changing events - but rather 'consumer-related' issues (such as car buying). I believe people can even pay for counselling. So we get people endlessly stressing over whether they go for a particular make/model/spec of car, as though their life is going to end if they erroneously choose the "pre-'05 facelift", or whatever. -
Nissan Leaf - Refusal of Short Term Right to Reject 16 Mar 2022 (Forum)
I booked it into a Nissan garage to have it looked at and received a report back that stated the front anti-roll bar bushes needed replacing and both o/s and n/s would need to be done, on top of that they also stated that the 12v battery was only at 50% capacity and there was an outstanding recall on the car. After gaining some further advice from CAB I was told that I had a short term right to reject, within 30 days under the Consumer Rights Act 2015. So, I did this under the 'unsatisfactory quality' clause of the Act. I emailed the dealer, and explained the situation and exercised my right to reject under the CRA due to unsatisfactory quality.
