  • Has the dealer breached the law and what can I do? 3 Apr 2024 (Forum)
The repair was paid for by the previous owner's insurance, which proves that the vehicle had a front-end collision before and was repaired (perhaps poorly). After doing some research, I believe I'm covered by consumer protection legislation. The Consumer Rights Act 2015 requires vehicles to be of satisfactory quality, fit for purpose, and as described. Otherwise, I have the right to reject the vehicle within 30 days.
  • VW Touareg - 8 month old car new/used parts for warranty repair 28 Jun 2016 (Forum)
At such a young age, do I have to accept a re-manufactured replacement or can I insist on a new component? The car was bought after 1st October 2015 so the new Consumer Rights Act applies and I'm aware I can demand a refund if this fault occurs again after repair.
  • Merc Vito 108cdi - Serpentine belt 26 Oct 2012 (Forum)
In the meantime they suggest I buy another from them and await the result of the tests. Is this the correct way to go? Do I have any rights under consumer law to demand a replacement immediately? I was willing to go with a straight replacement, but now I feel as though I should request the costs associated with a replacement, ie: new belt and additional costs for a mechanic to fit it once again.
  • Some questions about wheel bearings 5 Mar 2008 (Forum)
(car has 70,000 on the clock) 2) What factors would cause a wheel bearing to wear out faster? 3) Would a Berlingo wheel bearing be a time-consuming item to fit? 4) Would a Berlingo wheel bearing be a fairly unique part, or would it be the same as other Citroen wheel bearings? 5) MOT was done by a Citroen dealer. Should I have expected them to tell me that the only problem was a wheel bearing, and offer to put the problem right there and then?
  • Volvo V90 - Repairs on new (to me) car 23 Apr 2021 (Forum)
Need some advice on where I stand with my consumer rights, if anybody has the knowledge. Earlier this month I picked up a Volvo V90 from an independent dealer. The day after delivery it threw an error code for the left tail light. Dealer I bought from said if I got them a price they’d “see what they can do” about paying for it...
  • Ford Focus II (2004 - 2007) - recently bought car has had previous crash repair? 15 Apr 2009 (Forum)
I am feeling a little foolish now for not noticing some tell tale signs. My question is what consumer rights do I have here. I have read some of the Scottish Law in relation to purchasing second hand cars but nothing is that specific. After giving £9k I am annoyed I am the proud owner of a crashed car.
  • Car blew up & and was stolen the same day I bought 13 Jul 2024 (Forum)
I have some assumptions about what's transpired here (pretty easy to jump to conclusions) but I'm going to let the police do their job (or not). I thought I understood my consumer rights pretty well, but I'm confused about whether I have any legal recourse without the vehicle. Could I still take them to small claims court? I have a trail of evidence with regard to the fault.
  • Landrover Freelander - Consumer Rights Act 2015 10 Feb 2017 (Forum)
In October last year I bought a 6 year old Landrover Freelander from a registered car dealer for £15,600. The car was serviced, MOT'd and had a...
  • Delay in fixing car 15 Apr 2024 (Forum)
Tried private auto electricians but there are no after market parts available either… I am wondering if I would be entitled to any sort of compensation towards the cost of the eventual repair as it has left me without a car for months and the quote for the repair was over £700! Not sure who to ask ie omburdsman about any consumer rights
  • All - Advice given on HJ Questions 13 Jun 2021 (Forum)
Always read the advice to questions on the site and find some of the answers not at all helpful Today a chap as a Honda Civic with a faulty alternator part claimed to be £1100 No practical advice  given other than usual consumer rights etc  How about suggesting he go to a specialist auto electrician or independent garage or source a part from the many parts recycling outlets. The Honda Civic is a very common car Again chap with a BMW 7 series he has a failed module for wipers and indicators.
  • Vauxhall Insignia - vauxhall radiator 19 Jun 2017 (Forum)
Should radiators really be failing with just over 3 years useage in normal uk conditions? Where do i stand in with regards to the consumer rights act in getting the dealer that i purchased it from or the warranty to fix it? Many thanks in advance
  • Toyota Rav4 Gear box and squeaks! 2 Nov 2003 (Forum)
Their repairs would invlove stripping the gearbox which requires the engine to be removed!! Am I right in thinking that under consumer law I can demand a refund or replacement vehcile? What would others do? SeanC
  • Shafted by Small Call Dealer? 28 Aug 2022 (Forum)
I wouldn’t have picked up any of these things if I’d gone to see the car before buying, although I might have picked up the smell of petrol. I’m trying to figure out if I have any rights under the Consumer Rights Act. Am I correct that even just the fuel tank issue (which is potentially dangerous) meets the definition of a significant fault? Many thanks in advance.
  • honda frv - air con fault 3 months after purchase 28 Jul 2018 (Forum)
im trying to find out what my rights are under the consumer rights act 2015. ill try and bullet point rather than a huge storey. bought the car in march (snow on the ground then) everything was fine. I commented at the time i couldnt test the aircon because it was so cold independednt inspection dated 6 months previous says aircon was working (not including gassing) weather warms up and i start using the aircon. notice there was a whiring sound when its turned on and revs drop suggesting compressor kicks in. within a week or so this stops so i take it to dealer for regassing that lasted a couple of weeks so take it for diagnosing. condenser and receiever pipe is corroded the car has a 15 month warranty but not covering corrosion used car dealer says 'his legal team' this is classed as service parts so they are not liable.
  • Peugeot 3008 - Used car fault after purchase 4 May 2018 (Forum)
I had it towed to the garage i purchased it from and although they haven't given me an estimate on the repair cost, it's obvious from emails and phone calls that they intend to charge me normal parts / labour costs. I've done a bit of research and discovered that the Consumer Rights Act of 2015 states that if the purchase of a car is over 30 days but less than 6 months ago then you have the right to demand the car be fixed at no cost because the law implies that the fault was probably there when you purchased it unless the garage can prove otherwise.
  • Nissan Bluebird (1986 - 1990) - 1990 1.8 Head gasket blown 13 Feb 2009 (Forum)
Once the RAC started the engine, tons of white smoke was being emitted from the exhaust, so I think their diagnosis is the right one. Knowing the good history and general good condition of the car, it might make more sense to repair it than spend the repair money on an unknown replacement car. So my question is this. Is there anything else that will likely need replacing (thermostat etc), and how big and time consuming a job is this on a Bluebird?
  • MINI Clubman - Dealers selling privately 29 Dec 2023 (Forum)
I'm confident he is a car dealer (seems the account i paid the money into is his trade account as well) so can i reject the car under the 30 days consumer act?    The car was advertised as private and i viewed and bought the car at his home address. He did not state he was a car dealer, in fact he said he was a barber!   Im not sure if this is a criminal matter as in fraud or a civil matter as in consumer rights act?
  • 2013 VW Passat 2.0TDi - My rights on a second hand car bought from dealer 9 Jun 2018 (Forum)
Would I be able to do the thing where I can demand a full refund within the first 30 days under the Consumer Rights Act or is this particular scenario not entitle me to do that? Any help would be greatly appreciated as I would like to know exactly what I can respond to him with or where I can take this.
  • SEAT Leon ST - Within 30 days right to reject, dealer refusing to 22 Nov 2022 (Forum)
As far as I can tell I will not have to pay them a weekly rental, I cannot find mention of that anywhere in the Consumer Rights Act. But I do have to pay the mileage. When all is said and done I will then have to take them to court to get back any of the other associated costs and this weekly rental which they are illegally charging me.
