Insurance claim - a witness that's not a witness?

I was involved in a minor accident in the evening. I have a witness who is known to me, and said that the other driver was driving without lights. My insurance company says that this is not adequate for them as my witness is known to me.
I did not claim on my policy.

They are pressing me to accept their conclusion, The result will be that I will have to declare this on my insurance. I do not consider this to be reasonable, but what are my options?

It goes on your claims record whether your fault or not and you suffer a hike in premium whether your fault or not.
