    I finally after speaking to the salesman got speaking to the sales manager this evening who insists under the law he is only obliged to fix the fault, I have no right to a refund and he will not accept the car back. And when it comes to consumer law I don't know what I'm talking about. He also insists the fault was not present when I bought it, even though my sources tell me that if the light is on continuosly that it would have been preceded by an intermitent fault which would still have shown up on the code reader.

    But for future reference, lets discuss this refund policy. A scrapyard is a business like any other and the consumer has rights as with any other retailer. If the scrapyard sells a faulty component they are surely obliged under law to refund, repair or replace the item. Factors affecting this would obviously be that you cannot expect an old component to be perfect and you cannot expect it to last very long.

    But remember they still mitigated their mistake by repairing it up to 75% of cost after the customer complained. They had no choice under consumer law!! As for the courtesy car, normal procedure is to ask before car handed in whether a replacement one will be supplied for the duration of service. Before the next service, find a garage that will agree to this.

    Back in August, I took my Xsara for a drive, got on the dual carriageway and after about five minutes the temperature gauge had shot right up to max, so I pulled over and checked under the bonnet. A spring of clear fluid appeared to be coming from one of the pipes to the right of the engine, and there was a funny smell. All of the coolant in the coolant tank had gone.

    We bought a car for over £12,000 and the first time it rained it was clear that the roof was leaking. We returned the car to reject it as is our right under the Sales of Goods Act 1979 as it was not fit for purpose and they refused to refund us our money. They then drove and fixed the car without our permission and attempted to force us to pick the car up by charging us £30 a day storage.

    He said he wouldn't take the car back and that if I wanted to take it further I should take him to court and that he would 'see me in court'. What are my rights as a consumer? Have I been 'conned' or is it my own stupid fault? How can I go about getting a refund? To recap : 1995 M reg Honda Prelude 2.0 Silver Price Paid £2400 - the mileage was advertised as 95,000 - it has actually done 105,000 - I was told the respray was due to the car having been keyed - I now have reason to believe this was actually because of accident damage. - I can now smell an oil/petrol smell - particularly at low speeds - I didn't smell this when I test drove the car - Receipts - I have a receipt for the Debit card part of the transaction (£1500), but even though I asked them to they wouldn't put the cash on the receipt (£900) - I have since written the £900 on my receipt, but of course it won't be on their duplicate copy.

    I also do not agree that you have incurred any losses since you admitted yourself that this particular vehicle “is the cheapest in the country right now” and would sell again easily. Please comply with your legal obligations and return my deposit in full, otherwise I will have no hesitation in enforcing my consumer rights through the Small Claims Court.

    They have declared the vehicle not fit for purpose in their write up. I want to reject vehicle under the 30 day consumer protection laws but dealer says this is wear and tear. I’ve only had it 10 days and nothing’s happened to it in that time. This car seems to be unviable to my mind but I can tell this dealer might not do the right thing.

    The car had been serviced prior to sale and I was assured by the dealer I would have no immediate costs to pay out on the car.  There was no warranty but he assured me I had my consumer rights. I contacted the dealer regarding the fault.  I explained I had two quotes, £205 and £200 + VAT, and asked him to pay for me to have it repaired locally.  The dealer stated two things.

    Went back to the dealership with the findings who then refused to help at all by arguing that i did not purchase additional warranty so its not covered. A warranty argument at this stage is red herring as consumer rights act is clear on major faults happening within 6 months. Second issue i have come across is that i was trying to find the service history and records to see the car had been looked after and noticed the car is missing service history since 05/2017.

    I have gone back to the seller with this news and he claims that when he got the car he took the MOT as gospel... however, he has ended up selling me a car that is currently unroadworthy!! I paid over £5k for this car so I am keen to know what my rights are as a consumer. Should he have sold me a car in this state... and by claiming he didn't know about these faults meant that he is not liable. And if the MOT guys claim that the car was fine when they did the MOT 6 weeks ago, should I suspect that the guy who sold me the car has altered it before he has sold it onto me (although I appreciate that may be difficult to prove) Please help :(

    The firm are not easy to deal with, and I suggested if they get nowhere by being polite and asking for some contribution towards the new disks and pads, they might try the very helpful consumer programme on Radio Northampton. I would be glad of any thought BRers might offer.

    My query is more to do with my consumer rights than mechanical matters. I have a petrol Citroen C4 1.4 which I bought brand new 7 months ago. In the last fortnight the car has developed a "flat spot" when changing from 1st to 2nd and 2nd to 3rd (the car jumps very violently and usually cuts out).

    Hello I'm considering buying a car from a dealer 120miles away & have some concerns.  If a fault appears within the consumer rights 2015 timescale, who would be responsible for the cost of transporting the car back to the supplying dealer? I have to confess, I am very apprehensive about dealing with the business as from communication so far they seem like the type for whom "after sales" is a swear word, but that seems to be quite common at the cheaper end of the market.

    At this I point I put a notice into Honda finance, as this is a PCP bike that I want to reject it under section 9,24 of the consumers rights act 2015. I have already given Honda a chance to repair it once and section 19 states that I have to allow one repair. Which I did in May. Meanwhile, I notice rust appearing on the frame!!!

    So after a lot of consideration and what seemed a lot of research/thought/discussion I went for a high mileage 2014 Toyota Prius UK model (£0 road tax along with cheaper insurance than an import). This was purchased from a dealer for an added "security" peace of mind via credit card (consumer rights protection?) and their 3 month warranty on engine/mechanical and 6 months on the battery. Came with a reconditioned battery the day before (invoice to prove it). I went about looking for a car trying to avoid a lot of pitfalls that you hear and learn in life.

    Leak on rear shocks absorbers Etc etc I’ve contacted with seller, no answer I’ve checked with MOT history and found same issues were advised on last MOT but as seller has not told me about them I was under impression it’s fixed My question, could I use my consumer act right to reject to accept this car and pass it back to seller for full refund, just worried, as on paperwork I’ve sign it was a statement “I have fully inspected it and found it in satisfactory condition “

    Any advice (practical or legal) as to where to go from here? With reference to the Consumer Rights Act, can I compel the specialist to arrange to get a professional mechanic to look at it (bear in mind moving it will cost us as it won't drive any more). Or should I cut my losses with him and sort things out myself?

    Following this I wrote a letter detailing the entire experience and explaining that they were in breach of the consumer goods act. I asked for a partial refund of £400 to cover the cost of the missing features and a little compensation for the way I was treated. I recieved a prompt reply which again fobbed me off.

    - It is the law that If you buy a faulty car from a private seller who turns out to be a car dealer, you have the same rights to a repair, replacement or refund? So we are legally entitled to a refund. - It is illegal to write 'Sold as Seen' on any receipt for a car and is grounds for reporting the sale to consumer direct.
