A car "scraped" into me today whilst driving on a 2 lane into 1 lane road at slow speed of about maybe 20 mph. I have small scrape and so does other car. As far as I am concerned it was other drivers fault but no doubt they will say opposite. I do not want to claim on my insurance. How is this all dealt with ???

You don't have to claim on your own insurance, but you should notify them for information purposes, if you have a good case then you should claim from the other drivers insurer.

It may well be taken out of your hands if the other driver tries to claim from you.

Be prepared for it to drag out interminably, but hopefully the other driver is seeking the same as you.

Things were so much simpler a few years ago, when people were more likely to tell the truth and small things like this were sorted with a calm discussion (hopefully) and an agreement to pay out of back pocket for small claim...a blameless driver would usually get the damage sorted as cheaply as possible as fair reward for doing the decent thing.

Sadly thats now a thing of the past in most cases, good manners honour and fair play now history it seems, where did it all go wrong?

You should tell your insurance company ,regardless of whether you need to get them involved for repairs to your car or not ,if you don't you risk invalidating your insurance cover .

I suppose as a rough idea if the other car was on your right ,when the accident occurred, they are more likely to be liable than you ,however you are likely to find that the claim will be resolved on a knock for knock basis .You will pay for repairs to your car ,the other driver will do the same .

Under S170 Road Traffic Acr 1988 - owning to the presence of a motor vehicle on a road an accident occurs whereby damage is caused to any other vehicle there is an obligation to

STOP and exchange details (if injury also Insurance details). Failure to do so an offence. Fine and points.

But if not possible to exchange dertails then there is an obligation to


REPORT the accident to the Police as soon as reasonably practicable and in any case within 24 HOURS . Failure to do so offence - fine and points.

Have you complied. If not and other has then you could be in the doo doo.

Thanks for all the replies, sensible and useful (makes a change for a forum,lol). In fact really my car is only little scrape and is not a new car so I am not really bothered about repairs as makes no difference.

As for the incident itself, the other vehicle was in the right lane (offside) and I was in nearside lane of the 2 lanes. The right lane had an arrow telling right side (other vehicle) to merge into the left lane BUT they carried on further into the chevron area before moving left into the side of my car. I guess that makes it their fault ?.
