Bill to ban rogue clampers. - Dutchie

Read a figure in our local paper that Cowboy clampers take up to £55 million every year frrom the motorist.

The bill to ban cowboy clampers is discussed in parliment this week.Once the bill is in force only police councils or official bodies such as the DVLA will be allowed to immobilise or remove cars in exceptional circumstances such as cars blocking a road or vehicles which are untaxed.

Lets hope it is sorted out in parliment this week.

Let's hope the bill gets an easy passage.

I hope they make sure that the law is drafted in such a way that it doesn't become illegal for someone to clamp their own car or caravan to prevent theft. If a car is parked illegally, causing an obstruction or hazard, clearly clamping it just makes the situation worse. Removal is the solution, and should be carried out only by the authorities and not by contractors acting on their behalf.

In Gods own country only the Local Council (& their contractors) or the Police can clamp.

Scottish Courts ruled donkeys years ago on this as otherwise it is extortion.

Mind you my son suffered when he lived in a flat with day trippers parking on the grass and car spaces to visit local attractions = called police but they were always busy!

There is a flip side to this - tickets will be dished out instead and the registered keeper will be responsible - regardless of who is driving.

This cuts across hundreds of years of contract law and opens up the possibility of individuals being fined by any company, not something I want.

a private company CANNOT fine you , they can take you to a small claims court , but they can only claim for there actual losses , not a large ammount , and the small claims court has a limit on costs

example , aldi , first 2 hrs are free , if you stay 3 hrs , what have they lost ? 1 hr @ 0.00p , so how can they claim £50-£125??

Genuine question: How do private estates, small businesses with "customer" parking stop "illegal" parking when they will have no redress ?

John - how dare you suggest that drivers should not be allowed to park their cars / vans / trucks anywhere they want.

If they want to park on your front lawn why should they not do so! It's not your property (well it is but what's that got to do with it!)

You'll be saying next that drivers shouldn't be allowed to park in amulance bays in hospitals.

People need to park close to where they buy their lottery tickets / fags / booze etc it's in the Human Rights Act!

easy , they employ a car park attendant , to assist , just like the old days, or fit a gate barrier that is electronicly operated , one like this at batleys (cash n carry) in smethick to stop wagons parking up , you get a code number from the checkout , this is printed on your invoice

No need, as part of the same bill to outlaw clamping, the government is going to legalise private parking 'fines'.

Quote - "prohibiting wheel clamping – creating a new criminal offence to immobilise, move or prevent the movement of a vehicle without lawful authority. We are also changing the law so that parking providers and other landowners may seek to recover unpaid parking charges from the registered keeper of a vehicle "

Also the police will be given powers to "remove dangerously or obstructively parked vehicles from private land, in the same way as powers they already have on public roads."

And you can bet that the police will subcontract this out, and getting your "obstructively parked vehicle" back will not be free. How much is it they charge when it is towed away for no insurance, £150?
