How can I get a motorcycle registered in my name without a V5?

I swapped my running moped for a spares or repair motorcycle. When I swapped we did not fill in the V5s or send them off because he did not have his V5 on him at the time and i forgot to get a receipt. He's now broken my moped by messing with it, and he has found out that I have fixed his motorcycle. He now wants to swap back but I don't want to because it cost a lot of money to fix the motorcycle. I do not have the V5 because he refuses to send it off and I do not have a receipt - all I have are witnesses. Is there anything I can do?

You have possession. So use a form V62 to register the motorcycle in your name.
