Bought a car that is not as described - what can we do?

My son test drove a Mercedes-Benz SLK200 last week. The seller was not available but his girlfriend let my son test drive the car which he agreed to buy for £5800. As my son was not available to pick up the car, I picked it up for him and paid cash.

On arrival home I checked the last service report and found that the Mercedes garage which serviced the car had stated that the car had an air con problem - it needed a new condenser and pipe. t also recommended both sets of torque strut bushes and both sets of cross strut bushes be replaced as they were either worn or split. Total cost approximately £1800.

The seller advertised the car as "lovingly looked after and beautiful condition". I feel the seller did not disclose the correct state of the car with the known faults. Do we have any recourse?

You could take small claims track action for breach of contract in that the car was described as "lovingly looked after and beautiful condition" because it wasn't and the owner knew that and the proof he knew is in the service report. You could sue for the repairs or for a complete refund.
