Failing synchromesh on a used car bought from a dealer?

I recently bought a used 58 plate Audi A4 avant from a dealer, less than three months ago.

A few weeks after buying it I noticed that at times it was sometimes quite hard to select first gear from stationary (requiring a release of the clutch to spin up the gearbox and then being able to select 1st) and that there was a slight crunching of the gears between 1st, 2nd and 3rd gears if rapid gear changes were made - even when the gearbox is warm.

I noticed that in the service history that last year it had a clutch and DMF change - so I am pretty sure that this is not a clutch issue.

It is currently being looked at by the dealers workshop - however they have alluded to the fact that if the syncromesh is failing rather than failed totally that this will not be included in the RAC warranty provided with the car.

Where do I stand on this issue both with the RAC warranty and also being covered by the sales of goods act with the dealer themselves?

These are your rights: www.honestjohn.co.uk/faq/consumer-rights/ Basically the dealer has to either fix it or return your money. Whether the RAC warranty pays or not is his problem, not yours.
