Problematic Kia Sorento geabox

From new the transfer box has been replaced twice under warranty on my Kia Sorento due to faults. The last time was in May 2012. In December 2012 I reported that it was faulty again, but the dealer didn't want to know until I could prove that the transfer box oil had been replaced as scheduled.

A new turbo and timing chain were fitted in December at my cost as the manufacturers warrant expired in August 2012. The transfer box oil was changed in April 2012, and the dealer fitted the new transfer box in May 2012. In Feb 2013 the dealer wanted to charge me for changing the oil again in case the oil had degraded.

I refused to pay, so the box was reinstalled without any repairs. They have washed their hands of it and they are saying that, as I didn't pay for the last replacement, transfer box, it was only covered up until the car's manufacturer warranty expired (August 2012).

What are my rights to a repair free of charge; should the dealer investigate the fault at their cost?

The reason for this sort of failure is usually a mismatch of the circumference of the tyres front to back, which confuses the transmission electronics, but for which neither the dealer nor KIA is liable.
