I purchased a second-hand diesel Freelander from a trader in Melksham on 18th April 2009. It is a 2006/55 plate with approx 51k mileage when I bought it. I paid £7,795 and have done 3,000 miles since. I was told there was a 3-month warranty, which I have found out the trader failed to purchase. One week before the three months was up the gearbox failed leaving me with a repair bill of £1,200. Initially the trader failed to respond to my calls or e-mails and only after visiting them have they have offered me 50% of the repair cost. Is this reasonable? I feel that they should be liable for the entire cost of the repair.

The law (that’s case law on the various statutes) says he has to pay for all of it, or take the car back and give you your money back. If he won't, use the Small Claims Track of the County Court. Your problem is you can’t sue for more than £7,000 using the Small Claims Track. See FAQ Consumer Rights at www.honestjohn.co.uk
