NOX what it seemed

I wonder if you could reply to this snag we have, please. Two weeks ago we helped our son out to buy a used 2004/54 VW Golf 1.6FSI, 33,000 miles on the clock, great condition, FSH, bought from a non VAG dealer. On driving home the engine indicator light came on, so we took it to our local VW dealer and for £50 he said the NOX sensor had failed, cost about £400. From your opinion should this be covered on the dealer’s warranty? I can’t see why vehicles have these fitted as the emissions are tested annually on the MOT. I now tend to hear that this is quite a common problem and this light may have been” turned off” prior to the sale. (I may be wrong). Is it also wrong to drive the car in this condition, the light is permanently on and quality non-supermarket fuel is used.

No. You had to alert the selling dealer to the fault and give him the
opportunity to fix it. He does not have to pay for someone else's work on the car not authorised by him (and possibly overcharged for).
