The sum of all gears

I have been recommended to write to you by a friend who reads the Telegraph. In short, we bought a brand new Grand Cherokee 3.0 CRD in July 2005. It went back to the dealer with gearbox problems at 1 month old, then throughout the warranty period it was returned numerous times with the same problem. Two months out of warranty the car was again returned same problem. This time we were told the gearbox needed completely replacing at a cost of £12,000 and we had to put £6,500 towards this. We contacted Trading Standards and wrote letters to Jeep Finance. They were to conduct an investigation within 8 weeks, but we heard nothing so wrote again and again heard nothing. We contacted SMMT and Financial Ombudsman. Yesterday, out of the blue, the Jeep dealer rang and said the price of the gearbox had decreased to £5,500 and we should pay £1,000 or would have to take our case to court. We feel we have been backed into corner Can you please help?

If you are only being asked to pay £1,000 rather than £6,500 then you have to consider the potential cost of fighting this through a court. Because the transmission has always been faulty and because this is well documented you stand a good chance of winning on the grounds that the transmission was never "of satisfactory quality". But you might lose. This will certainly cause further delay. And it could cost you more money. See FAQ Consumer Rights: Rejecting a Duff Car at www.honestjohn.co.uk
