Nissan Qashqai - How to deal with a spiteful, sloppy Nissan dealer. - Intelaken

I'm new here so patience please if I get things wrong.

3 weeks ago I saw on the net the car I had been looking for at a Nissan dealership in a town with a duck connection some 120 miles from my home. Phoned up roughly agreed deal on phone to part ex my 2007 Qashqai.

My existing car was on a cherished plate. I was keeping the plate but did not have time to retain it before swapping cars.

On the day I went to do the deal I had paid for 1 years tax on the new vehicle still on its own plate. The old car had 8 months tax left so I removed the disc to start the procedure on line to retain the cherished plate on my return home and claim my 8months tax back using the disc.

2 days after puchasing new car it became apparant that previous keeper had been a smoker. Car stank of fags suddenly and so did everything I put in it! I contacted dealer who I felt must have known about this and he agreed to pay for a valet which I had to organise.

2 weeks later I got a letter form DVLA saying I could not get my tax back because dealer had re-taxed my vehicle and had the disc I needed. It has taken me 3 weeks now to get that disc from the dealer. Fibs were told about the posting of it and because we are now passed the 1st of the month I have lost 1 months tax.

I wrote to the dealer saying I wanted valet money (enclosing receipt) and 1 months tax.

Today I have just got a cheque for the valet. What now? I am fuming.

This is the first dealership I have ever gone into where the staff are munching pizza in public and the bloke trying to sell me rubbish gap insurance had food all around his mouth. Yuk!

Any advice appreciated and I don't recommend this dealership at all.

At least you got the valeting paid for, and you may have to settle for that. You can try asking the dealer again - stay polite and justify your claim succinctly with the facts - but you'll be relying on their goodwill as there doesn't seem to be any contractual liability.

1 month's tax is too small an amount to go to law about.

Thanks for that reply Avant - I agree the amount is way to small to go to law about but this dealer has obviously not heard of 'customer service' or 'goodwill gesture' and it has got his business a bad name.

Any other replies welcome.

Have to agree with avant ,it largely comes down to one months tax ,not worth bothering about ,their are very effective car deodisers on the market ,it's possible the original owner used one before part exchanging it .The dealer paid for your valet as a goodwill gesture ,he didn't have to do that .

Staff munching pizza ? Their are no recognised lunch breaks for car sales people ,it's a case of grab a bite to eat when you can .

Gap insurance ,it's the best of all the ppi products ,relatively cheap and a huge benefit if you're car is written off .You don't have to buy it from the dealer ,it can be bought cheaper elsewhere .

Thanks all for your various replies.

No, I did not smell fags on inspecting the car but a pleasant scented smell - obviously a temporary mask like Febreeze had been used. It has taken the full £55 intereior valet to eradicate the smell and valeter agreed a masking scent had been used. If I had realised prev owner was a smoker I probably would not have bothered to go and look.

I have been in touch with original owner (Friends Re-united is such a usefull tool in these matters). He is a smoker and did not deodorise car prior to trading it in.

Vehicle only 10 months old and I have no issue with it - it was and is perfect - now I have got rid of fag smell.

Of course I test drove the car and was happy before parting with my cash though salesman did seem surprised I wanted to test drive.

I did buy gap insurance down the phone from a British company at half the price dealer quoted.

All dealerships I have been into seem to have a separate area for staff eating. Likewise I don't eat in front of my clients and I have to take breaks when I can.

Am I spiteful? I don't see how you can make that assumption on one post but having read your replies is seems that I obviously expected way too much in the way of customer service - probably because I am a woman!

Didn't you spot this on the test drive and initial look around the vehicle ?? If it was this bad you surely would have.

If you don't like the dealer, go to another one. I don't see why this is a difficult concept?

I got s***ty customer service in a certain electrical store (name is a space-dwelling flying rock), so now I buy from the place that sounds like an indian meal.

Sounds like the OP bought the car blind without a test drive. I have done this three times. On the first occasion it went like a dream (the car was near enough perfect and the dealer did not lie) and on the second occasion it was poor (although not awful) as the car was not as well presented as indicated by the dealer. The third time was back to perfect again. However, I think I would see the car in the flesh before I bought, if I did it again, unless there was a get out clause.

I wonder if distance selling regulations would help the OP?

I would think that distance selling regulations only apply when a transaction is completed over the phone or by e mail etc .The op agreed the basics by phone ,but completed the transaction on the dealers premises ,

As I understand distance selling ,you would have 7 days ,after delivery, to reject the goods ,if the purchase was completed prior to you having pocession of your purchase .

I'm not sure that only quality issues are involved with distance selling ,not having seen the goods prior to purchase ,I believe you would be able to reject them as unsuitable as well as defective .

I don't believe the op did buy blind ,I believe he organised the deal by phone and then did the deal at the dealers .

While the dealer may be sloppy, the spite seems to be coming from the OP.
