Not applicable - Licence revoked in 2007...I learned yesterday - cranbury

I inadvertently learned yesterday that my licence had been revoked some years back. What recourse do I have if I am convinced that this was done without justification?

The background...

My wife and I were in process of renting a car and during processing I realised that my licence had expired. I could not remember being sent a reminder about this. However, I called DVLA whilst at the rental agency.

Imagine my shock when I learned that the DVLA could not accept a renewal request via phone, because my licence had been revoked several years back as I had failed to submit it for endorsement for 3 points for a speeding offence.

When I asked the DVLA when this might have happened, the date they provided did co-incide with the endorsement on my licence.

I have rented other vehicles; have driven other passengers in my car; made fulll disclosure of my points when renewing my insurance - only to learn that I have been dong all this illegally.

Having committed and accepted one has committed the offence of speeding then one has to surrender the Driving Licence for endorsement. Details are then sent to DVLA of the conviction.

If the Licence has not been surrendered they they cannot update your Driving Record which gives them the power to revoke your Licence. One has to apply for a new Licence using form from PO andf photo at which time the endorsement will be added and your back on the road legal.

It will then depend when the revocation was imposed as to what record there was when hire checked etc if they ever did or just accepted the Licence in your possession.

Reminder to those with DL over ten years old. You are supposed to renew every 10 years unless a coffin dodger (every 3 years) Fine for not doing so. Apparently DVLA has just announced there are a million plus that have not complied.

Thanx for the quick reply DVD.

I agree with you, had I not surrendered the licence for endorsement, there could have been justification.

However, the endorsement is shown on paper licence, and the DVLA have confirmed to me that the corresponding 3 points appear on my driver record.

I accept that I may not open all my postal mail as soon as it arrives; though I don't believe that if the supposed three letters from the DVLA had arrived in a 6-week period, that I would have ignored them.

( I'm still resident at the address shown on my licence.)

I should have also said, that the speeding conviction was at a magistrates court, I have spoken to them and they are happy to confirm to the DVLA that they should not have revoked the licence.

When I subsequently spoke with someone at DVLA, he told me that irrespective of the court endorsing my licence, it was still necessary to send it to the DVLA.

However, as I said earlier, the endorsement is reflected in my driver record with the DVLA.

BW, good point about the 10-year renewal.

Of course, as a result of my licence having been revoked, I was not sent a reminder to renew either.

From what you say then your Licence was surrendered to Mags Court Clerk who on conviction enters endorsement on counterpart and forwards Licence back to you. At same time notifies DVLA of endorsements. Licence would only be forwarded to DVLA if substantial Disqualification took place.

Looks like a glitch took place in the system where there are some 30 million plus records so not a surprise.it happens now an again.

As I say reapply for Licence.explain circumstances in full and see if they will return the re-newal fee.

Whilst technically you had no Licence - Insurance would not be void as your policy will cover a person who 'holds or HAS held a Licence'

i also found out friday after being stopped at a road side check that my license was revoked in 2007 for not sending my license of to have three points put on it for speeding , when the police checked for tax mot and insurance they all came back good but the revoked thing came up after sorting out my dad on the insurance he was able to drive van away. I am now conserned that my insurance will not be valid and i will also be done for that as well, does anyone no where i stand on this matter and what punishment iam looking at when i have to go to court for the revoked licence thanks for taking time to read am starting to worrie now as iam self employed and need license for work

True if you have a new-style licence: the old paper licences like mine expire only when you reach 70. A good reason not to change unless and until they make me.

And if Euro licences get introduced in the next 5 years, that'll be two types of licence I never had - the pink paper one and the current photo licence one.

The photo licence is universally accepted as photo id, an increasing requirement these days.

The fact that you don't have a Licence should not cancel your Insurance.

Look at your Certificate. Does it not say that driver is covered PROVIDING that he holds OR HAS HELD a Licence to drive which you have.

Only offence I can see so far is No Licence which would give Plod power to seize your motor.
