Nissan Almera - Accident - no witnesses - E17latic

My partner was driving our car the other day when she was hit by a van at low speed, over her side of the road, as she approached a junction.

There were no witnesses.

The accident has caused some damage to our car: scrapes and a dent to the front wing which has caused a gap between the wing and the bumper.

My patner and the van driver exchanged details at the scene with no admission of liability as one would expect. The van driver was driving a much abused vehicle and was unconcerned about the limited damage to his own vehicle.

My question is, without any witnesses is it likely that if we make claim on our insurance that the insurance companies will decide there was no fault and we will lose our no claims bonus. After all, it's our word against his.

Any advice welcomed.

If you claim on your insurance then, by definition, you will lose your no-claims bonus.

If you report it to your insurer (as you should) and try to prove it was not your fault and that the other driver's insurance should pay, you will have to rely on evidence like where the damage is on your car and that it could not possibly have been caused by your partner's driving. Do you have any photographic evidence? Legal protection?

This will probably tough to resolve in your favour.
