I've just renewed my insurance with a well known on line company. Much to my surprise there is a clause denying insurance to me if I am convicted for driving under drink or drugs. Third party insurance remains.

Anyone else come across such a draconian and aggressive stance?

Do you mean if convicted they will reduce your cover from comprehensive to 3rd party moving forwards or do you mean that in the event of a claim where DD is involved they will not pay out other than to a third party?

If the latter, I've never come across a motor policy that doesn't invalidate claims where DD is proved!

They will cover the third party claim but not yours if it is a fault accident in which drink or drugs was shown to be a factor.

well that sounds like good news the ! about time drivers face up to the responsibility of driving. Watching motorway cops and the like , its all rather worrying how many are driving whilst taking drugs ! Should be zero tolerance

Well, in 42 years of driving I've never heard of such a clause.

May as well say if you are convicted of speeding, careless driving etc . your insurance is invalidated.

Is this really a common or universal exclusion clause?

As far as I can remember in thirty years of driving, my insurance policies have always stated that your insurance would be invalid if you are under the influence of drink and drugs, speeding,reckless driving etc.

As a reasonable person I would have thought the insurance company would have comprehensively covered all risks. Then, at renewal time, hammer you with increased premiums should you have made a claim and you were also convicted of an offence.

Peoples circumstances change, who knows what events can happen to tip someone into law breaking.

This is all speculation however, and I will need to read the small print of my existing insurances.

If an accident occurred which resulted in a fatality, and the accident was caused by the driver being under the influence of drink/drugs, I would consider it extremely unjust if the driver received any kind of financial assistance from their insurance.

I was wanting factual replies, rather than perfect world pontifications.

My research of four big names shows that other companies may not pay out personal injury claims to the driver if convicted of drink/drugs offence. Only my new pachidermous company will decline paying out for own vehicle damage.

PI claims are only made if the accident is non-fault or split liability. If an accident is clearly non-fault then the claim would - in any event - be against the other party's insurer. For example if you were drunk and incapable but asleep in a parked car which a sober person ran into causing you injury then you would clearly have a potential personal injury claim.

A number of companies will refuse to pay if an accident results in damage to the at-fault driver's vehicle and drink or drugs are a factor. They would however settle the non-fault claim. So if you were drunk and put your car through a hedge they may refuse to settle your damage but they would pay out for the repair of the hedge to the farmer.

Some insurers will not quote for drivers with more than a certain number of penalty points and may cancel a policy on a conviction for a serious motoring offence.

Hmmm I wonder if I should be worried here, would this include my anti-inflamatories for my arthrits and the apple juice I drink because I can no longer drink alcohol ??

This isn't an aggressive stance its just plain commonsense !
