a friend had an accident a year ago and thought the claim was settled.

a letter has come from the other parties solicitor claiming money for injuries.

he has moved insurance companies and doesn't think he had legal cover.

should the insurance company still deal with it?

Motor insurance is based on events - insurance in place at time of accident covers it.

Unlike Professional Indemnity which is claims occurring.

Pass it to the insurer of the car in 2008 - they will deal with it.

If they cannot agree then things move on to court but most claims are settled before that stage.

I am surprised the solicitor writing directly to your friend and not to the insurance company who dealt with the original claim. Maybe the solicitor is flying a kite. In any event pass it all directly to the previous insurer immediately with a covering letter that states, this being part of a previous claim it is their responsibility to deal with it. Legal cover does not come into it, the insurance company will either settle or defend the claim. Concrete

yes I agree, it is strange that solicitors wrote direct, but as its a personal injury claim, probably through one of those crappy no win no fee adverts.

he is convinced that as he didnt have legal cover, hes not covered.

They have to write to you because the claim is against you. But then you pass on to your insurance to deal with it.

I wonder how this might affect the premium on their current policy - although the accident will have been declared.
