This driver was locked up for eight years for 'causing death by careless driving while under the influence of drink'.
He pulled across a junction into the path of another car - a momentary lapse - hence it's careless not dangerous driving.
It's a new charge, the court was told, introduced earlier this year.

This case is unusual. There is a big difference between one of us drinking the night before and then driving the next day under influence and then then doing that, we may be under the limit but the alchohol would affect it. I think the reason for the long prison sentance is the fact this guy has been convicted four times before, he did not have a clean driving record.

He was given 8 years because:
he was twice the legal alcohol limit.
It was the fourth time that Henshaw, a well-paid building site boss from Ingfield Avenue, Sheffield, had been caught drink-driving since the early 1990s, the court heard.
also admitted driving without insurance and a valid licence
Duncan McReadie, defending, conceded that his client's drink-driving was normal behaviour.
Judge Bryan Forster said "he had no regard for the people of this country".
And he was ugly

My opinion is that causing the death of someone else while being banned should have resulted in a life sentence on its own, never mind all the other stuff.
|
Something bad has to happen to him, or what was the point of a ban?

Good to know that they are now locking up ugly people. I have a little list ....
|
8 years for 2 lives. So for the full 14 year sentence a driver would have to kill at least 4 people.
|
I asume he will only do 4 years. Then he comes out, still with a lifetime ban...he will carry on driving until it happens again.
|
I don't know, Rattle they're pretty happy to send drink drivers who kill to jail anyway - irrespective of other previous convictions.
One of us over the limit the following morning who killed might well end up inside too.

I think it would really depend on the exact circumstances. If I had 10 pints on saturday and got in my car at 8:00am and knocked somebody down as a direct result of alchohol affecting my judgement then yes I would expect a harsh prison sentance. If I drove at 2pm knocked somebody down but they stepped out of the road, I still have alchohol in my system but not over the limit then it might be a bit harsh. I now have a policy of not driving the next day after a heavy drinking session as I cannot be sure it is all out my system.
Also although 8 years dosn't sound like a lot, time must go so slow in prison that 8 years would feel like a life time. Nothing can bring back the people who have died all they can do is make certain this idiot will never drive again before they even think about letting him out.

Believe it. I did 12 hours, and that was bad enough! That sound of the cell door closing is much written about, and I can assure you it is NOT pleasant!
