i recieved a letter about a month ago frm the dvla saying i am elegable to pay a £80 fine and tax or delare vehicle sorn if this is not done then it will be raised to a minimum of £1000. Now it also said that there is an address you can write to for any questions. i have sent a letter off and havent heard anything back. The problem is that when the vehcle was registered the DVLA registered as it something else!!! and everytime i went in to the post office i couldnt get tax as my insurance mot cert and V5 dont match up!!! now the end time of the £80 fine is up and i am waiting for a letter for the £1000. Is ther anything else i can do? everytime i phone they just say write to specified address and we cant help you ect... If it is there fault that it was registered incorectley then is it my fine???? Can i get round having to pay this unfair fine??? If it did go to court then what do you think the outcome would be???

I'm not sure what the outcome will be if you go to court, I expect you'll be done for not having taxed it. but what you should have done is returned the V5 immediately and got it changed. When you receive a V5 it says to return it if the details are incorrect. I did this when they got the colour wrong on mine.

Did you receive form V11 to relicense the vehicle? It states on the back that if the details on it are incorrect, you must relicense with form V10, available for download from www.direct.gov.uk/motoring or from your local DVLA office, or from a Post Office. I would have expected the post office counter employee to tell you to fill in V10.

You might still be able to go and fill in a V10, get it taxed, and pay the fine, but you are/were breaking the law by not taxing or SORNing the vehicle.

What is the exact problem? When I tax mine at the post office all they check is the registration number matches on the tax form, the mot and the insurance.

By the sound of it DVLA on their file in respect of your vehicle have it shown that there has been no VEL in force for over a month neither do they have a SORN for the vehicle. Hence an £8o fine has been churned out after a computer cull.

If you are having trouble getting sense from DVLA on a problem that appears requires urgently fixing then go their site on the WEB, find out where your nearest DVLA Local Office is, take all your docs and have a face to face to get it fixed. It may well be that they may be able to help in getting the 80 annulled as they have not helped in this matter.

Having read this earlier and given it some thought I find DVD has posted much the same answer as i came up with. As earlier post says it would be helpful to know a little more about the discrepancy, how/when it arose and the previous MoT history of the vehicle.

The £80 penalty issues one month after tax or SORN falls due and OP says a further month has passed since he asked for help. Seems therefore we are talking about tax that expired on 30 Nov, or possibly earlier. The £80 is a slap on the wrist for failure to comply with the regs on continuous registration, further offence of using the vehicle untaxed may also be being committed for which greater penalties including confiscation might apply.

The conversation with DVLA local office needs to be had asap backed up with readies for the overdue tax and possibly a degree of contrition if the owners action (or inaction) have lead to this position.
