Not that far from us, a car reportedly racing others crossed the central reservation and hit a lorry, bursting into flames and killing all 3 occupants , a few days ago.

It has been reported that the car was modified , with a Nitrous Oxide kit. My thinking, if this was not notified to insurers before , and with the big financial consequence of this crash, are the insurance company expected to pay out, or can they just chuck it at the deceased drivers' estate for recovery ?

Very few Subaru Imprezas are standard, so the fact that it's modified should be no surprise. They're also generally insured with specialist insurers.

So is a failure to notify insurer of modifications just pure speculation ?

more an educated guess , in so much as I'm not privy to that driver's insurance questionnaire.

My cynical mind thinks that a young Ali G wanabee would not be able to obtain insurance if all material facts disclosed ( Modified high powered car ) given his age /area/ type of car , so in effect driving uninsured in the event of a big claim such as this.

I am sure the insurance company would have grounds if the, alleged, modification had not been notified to them.

However, I would imagine that the claims would then end up being picked up by the Motor Insurers Bureau as, from the reports, the driver would have been late teens/early 20's and, generalisation, I know, is unlikely to have much of an estate to talk of in the realms of the compensation awards that are likely to be made.

In circumstances where modifications are not declared (and an accident occurs) the insurance company still have to settle with the 3rd parties (its not their fault that the driver is a liar) but they will not pay a penny out on their insured vehicle since the insurred has broken the T & C's by not declaring the modifications.

Well said skidpan- it's not generally known that while insurers can and will refuse to pay out on own-vehicle claims if they can find the slightest reason, they are not allowed by law to default on the third-party aspect of any claim for any reason as long as the premium has been paid.
