I was hit from behind on a roundabout early last November. I forwarded the sketch and all details to my insurance company (Churchill) within a week but they say the other side (Tesco Insurance) has not responded despite many telephone calls and letters. The insurance companies have a "protocol" after 3 months which is supposed to be a time limit for their exchange of information. Currently I am an "unresolved" claim so I have to pay the full excess on repair of my car which is £350 and have lost my no claims bonus until this issue is decided. Clearly I believe I am not to blame as I was hit from behind after entering the roundabout without changing lanes and there is no damage to my car except to the rear skirt. I cannot complan to my insurance company because they have done everything they say to get a response from the other side. I have written to the Financial Ombudsman Service but do not expect much to happen as I cannot complain about my insurance company.. There are rumours from my insurance company the other side are going to claim for whiplash and stress etc although the impact was only about 10mph speed difference. Am I about to become the victim of compensation society as a result of insurance companies settling 50/50?

If you were hit in the rear then its the other parties fault. Should be straightforward, if Tesco won't respond it sounds most odd.

I'm not normally on the side of the insurance companies but I think you might need more patience than usual. They have been absolutely overwhelmed in the last few years with fraudulent claims in certain areas and have been pressed by the government not to pay out like they were doing, in the interests of keeping insurance affordable and jailing these criminals who abuse our system.

I had a crash 9 years ago where the guy pulled out in front of me on a roundabount (rather than giving way).

We stopped, exchanged details, I took pics (of hime & his car).

Reported it to my ins co, they then started discussions with his ins co

But then the other guy never responded to his ins co's contact attempts.

I had my excess deducted, and 2 yrs no claims, but eventually his ins co paid up, as clearly the crash had happened. It did take a while though.

I am not sure it took 6 months, maybe 5 months.

But then maybe they are delving a bit deeper into some claims.

Back in the late 1970's I had a head on crash with a car that was driving on the wrong side of the road. Accident happened mid February and it was late October before it was sorted. Driver was in his mates car, his own insurers would not pay up and his mates insurers were not interested. Took a solicitors letter (cost me £5) and a cheque dropped on my doorstep for my excess and other expenses within a couple of weeks. My no claims was immediately reinstated. Never found out who paid, not bothered since I got my money.

I know but these days the roads are populated by pakistanis and afghanistanis who probably don't have any insurance.
