I've been prosecuted for speeding even though my wife was driving the car. What can I do?

I had a summons in the post saying I had driven at 41mph in a 30mph limit, and I could plead not guilty in writing. I did so, as my wife was driving the kids to nursery (in the vehicle which was speeding) and I would have been in my works van at the time. I mentioned in the letter that this was the first letter I had received about this offence and my wife was driving the vehicle at the time, but I then had a second letter saying i had to go to court.

I went today, told them the situation and said that my wife was driving the vehicle. They said it was too late to blame it on someone else and gave me six points and a £470 fine. Is there anything I can do to overturn this?

It sounds like they have dealt with you under Section 172 of the Road Traffic Act for failing to name the driver. You can appeal it - you need to do so immediately - and you appear to have good grounds to do so, but I will need to go through your case in more detail before advising how to proceed. Can you provide a phone number so I can arrange a free telephone advice call?
