Can I sue a lorry driver over a stone chip?

My camper van has developed a two foot crack on the wind screen. The crack developed while I was overtaking a tipper lorry, which was spilling some of its load through its tailgate. Before I had a chance to overtake, a stone bounced up and caused a two foot crack in my windscreen.

I managed to stop the lorry further up the road and told the driver what had just happened and asked him to pay for the repair. However, he just laughed at me and said I must be joking. I told him that I was an OAP and that I could not afford to pay for a new windscreen, but he wasn’t interested.

I sure that if something fell off my vehicle and smashed his windscreen he would want compensation, how do you think my insurance company will view this?

If you got the registration of the truck report it to the police for carrying an unsafe load, then use 'Just Cause' to obtain the details of the keeper and demand the cost of a new screen from the keeper. If the keeper refuses, use www.moneyclaim.gov.uk to sue for the cost of the new screen.
