How can I fight a parking charge notice?

My son has been issued with a parking fine, despite the fact he owns a valid permit for the space. On the day in question, my son parked up and displayed his permit, but it fell to the floor and wasn’t visible. I actually own the car and have received a Parking Charge Notice from PCN threatening Debt collection agency if I do not pay in 28 days.

I sent an appeal explaining the above and they replied saying this was rejected and sent a further appeal form through POPLA. I have been informed this is actually a contractual relationship only and they do not have the right to threaten action. I am happy to go to court, should I just ignore these strong arm tactics which I find offensive as the car has been paid for?

See what POPLA says. If it rejects your appeal then challenge the Enforcer and the landlord of the private car park to take you to the small claims court for payment. The Enforcer is employed to prevent unauthorised parking, but it is plainly ridiculous bullying for the Enforcer to have rejected your original appeal. You parked in a parking place you have paid for.
