BMW 120d engine failure at 4 years old (Full service history)

I have a BMW 120d that has suffered a serious internal mechanical failure, as yet not fully diagnosed. The car is full BMWSH and at 140,000 miles. I bought it a few weeks ago and the garage I bought it from are not being helpful. My questions are:

Is this common?

Have you heard of many total engine failures on E90? - is 140000 high?
The garage I recently bought it from is balking at repairing FOC becasue of the high miles, even though I am pretty certain SOGA means they should repair or replace.

I would like a refund, i.e. reject the car - is that possible?

May have destroyed its turbo and the blades were ingested by the engine, or the inlet manifold swirl flaps may have broken off and been ingested by the engine. Or the timing chain may have broken as a result of inadequate lubrication because the oil was not changed frequently enough. But if, as you say, you "bought it a few weeks ago", the garage that sold it to you does not have a leg to stand on and under the Supreme Court ruling in Clegg v Olle Anderson (trading as Nordic Marine) 2003, has to refund your money in full.
