For your information, below is the reply that I got from my MP Ann Coffey regarding clause 56 of the Protection of Freedoms Bill that allows parking enforcement firms to pursue registered keepers of cars for private parking penalties. “Thanks for letting me know your concerns about the Protection of Freedoms Bill. This is a wide-ranging Bill, and most people would welcome the proposal to ban wheel clamping. However, Clause 56 is clearly a problem, and this has been flagged up by Consumer Focus, Trading Standards, the CAB and others. Private car parks are everywhere these days and it seems that there is scope here for car owners to be fined when they have not necessarily done anything wrong. The Bill comes back to the House of Commons next month for further consideration by MPs. This Clause may be amended in Committee. Good MP you’ve got there. There was some progress: You can find the BPA Code of Practice at: www.britishparking.co.uk/Approved-Operator-Scheme-...e . Possibly as a result of our campaigning, the BPA is now running a pilot appeals scheme here: www.parkingforum.co.uk/adjudication_pilot / It states, “This pilot is designed to test the principles behind formalising such a service and may form the basis of a statutory appeals service when the Government legislates to introduce one.” Unfortunately this was not incorporated into Clause 56 of the Protection of Freedoms Bill when it passed its Report stage in the House of Commons on 8th November. So the very people who will lose their licence to clamp from next April will gain a far more lucrative means to exploit the public if they so wish.
