Wheels, tyres and VED

In June 2011 I purchased a new Mercedes E250 SE CDI Blue Efficiency with 7 speed auto box. The actual vehicle was in the local showroom on rather 'blingy' 17" wheels which I did not want for practical reasons - ride comfort, replacement tyre cost and wheel durability being the main ones. I asked the dealer to change them for the standard 16" versions and this was done.

The DVLA have registered the car as delivering 138g/km as per the original wheels and not 129g/km which is the published figure for the actual wheels on the car. They have used the factory issued certificate of conformity as the reason. The result is I'm apparently trapped into paying a higher annual road tax as the dealer has said that there is nothing they can do.

Is there really no way to arrive at the correct taxation class?

I'm afraid it remains 138g/km. Cannot be changed. That is the way the system works. Had the car come on 16" wheels and these been changed to 17" wheels it would have remained 129g/km.
