Not lovin’ it

Please can you offer some advice? We have recently been sent a "Parking Charge Notice". The Notice shows my wife's registered vehicle entering and leaving a MacDonald’s car park at Bell Lane London Colney, which is junction 21a off the M25 in Hertfordshire on 02/04/10, a not so Good Friday. We are being charged £50 for overstaying the 75minute limit, Actual stay 121 minutes. Payable within 14 days otherwise rising to £100. My deadline is the 23/04/10 but the letter only arrived on the 16/04/10, dated charge notice date 09/04/10, but two weeks after the "contravention date" of 02/04/10. So effectively I have only one week to stress and pay up. The circumstances were that we met with friends for a kids party (not officially booked) and get together at a mutual convenient meeting point. The site is quite inaccessible and we had to wait to get a space in the car park. Our defence is that the notices were not clearly visible, otherwise, had we known of such a draconian agreement between MacDonalds and MET we would never have used this restaurant. It would have been better to go to the large Sainsburys & M&S retail site across the road.

All they can do you for is breach of contract. If they want to 'enforce' anything against you then they have to take the matter to court and alert you as to when and where so you can go and defend yourself. In practice they never do. They use threats and extortion. See this FAQ:
