Hi

First post. Basically I am insured with Diamond & on the 27th December, whilst out driving in a car park a woman came out of a junction, didn't stop & went right into the side of my car. She blammed me & said it was my fault so we exchanged details & both phoned our own insurance companys (she is with Aviva). Since then I haven't got far. I got a text from Aviva saying they have accepted full liabilty but then Diamond phoned me & said they are still trying to get them to admit it? Hmm. Anyways, Diamond passed me onto a company Albany Assistance, which i've not heard good things about. I asked them for a hire car but they came to the conclusion I would be cheaper getting a bus.

Put my car into garage for repairs today & they said it will take a week. I was expectng a couple of days at least. Now I want to know what I am entitled to. I don't really want to get a hire car from Albany as I've heard they charge 3rd party for the hire at a very expensive rate & it could end up being me paying for it if they refuse.

Is there any other way I could get one? Or would I be entitled to bus fare etc back? I have fully comprehensive insurance

I'd have thought a loan car is or isn't specifically included in your insurance premium. I chose not to have one as it increased my premium enough to discourage me. If it is then your insurer will or will try to claim the cost back from the other party. What does your insurer say about who is going to pay Albany? If you're paying for it your insurer won't be motivated to get back your expenses. Do you have legal fees insurance with your policy or maybe if you have AA RAC? In the meantime take the bus and keep your receipts.

Make sure before you sign for the rent car that the bill is being picked up by the insurers and not you ,these companies are leeches that charge exhorbant prices and get you to sign for cars when your mind is elsewhere.

Why not just hire a car off your own back and charge Aviva for it, as they've admitted liability?

If you get one smaller than your own I can't see them having any grounds for complaint.

If Albany are Diamond's preferred hire provider , then they should provide you with a hire regardless of any liabilty admission. Albany would charge Diamond and its up to Diamond to recover damages from Aviva.

If you are getting the repair done via your insurance then you should get a hire whilst the car is getting repaired as part of the terms of your policy. However if you feel that Aviva are liable then contact them and arrange for hire via their preferred hire provider.

It shows you are trying to mitigate their loss by allowing them to pick up hire at their discounted rates.
