I scratched my neighbours boyfriends car in our carpark for residents only , he was visiting,shouldnt been parked there any way.. i went and knocked their door and admitted it and offered to pay for the damage,

he has since got a quote of £650 , by a garage up by where he lives, My Uncle owns a car body shop about 15 miles from me, i asked him to go and get a quote from my uncle even offered to pay for his petrol .. he refuses,... he also refuses to get other quotes he states he hasnt got the time..

now he is demanding my insurance papers to make a claim against my insurance.

please do you know how i stand , .. i thought i was being honest, i dont know what to do now or where to go to find out..Thanks

Your not obliged to give your insurance companies details,in circumstances like this .
However he could get the car repaired and pursue you in the small claims court to recover his expenditure .

You can't blame him. I wouldn't want my car repaired where someone who damaged it wants. It's enough hassle as it is.

However, if it was me who damaged the car, I would just let them pursue me if the repair costs were too much to pay in cash and forward it to the insurers and let them argue about it.

The OP has my sympathy. My Mother lives in a block of flats where absurd planning condtions mean one space per flat (even though some are multi occupied shares) and only four visitor spaces for 24 residences. However, it's still my obligation to avoid the selfishly parked cars on the forecourt.

You have two choices:

(a) Pay £650

(b) Refer claim to your insurer and let them deal.

Either will impact on your premium if not your NCB.

This is a tough situation Tinad, your honesty has backfired on this occasion.

In addition to the above options, you could insist he gets two further quotes to make sure that the £650 is not hugely inflated. He probably wants you to pay up because no doubt he doesn't want to go through his insurance either. Even though he is not at fault, he will still have to claim in the first place.

Also I suspect it might have been a bit more than a "scratch"?!

I can see the other point of view. Getting three quotes sounds easy, but it's not like car car insurance where you can get a dozen online quotes simultaneously. Body shops are not that common and you have to take your car to each one and wait for them to assess the damage and (hopefully) get back to you with a written quote.Then you have to go back to the original party, get them to approve the lowest quote, arrange a date for your car to be repaired, make arrangements for how the bill is going to be settled, get transport back from the repair shop etc, then get a lift to go and collect the repaired car...

A similar situation happened to my mother. Her car was scratched by a bus. The bus company wanted to resolve it privately. My mother agreed, but it was a lot of extra hassle for her compared to phoning up the insurance company and having a courtesy car sent to her doorstep.

If your Uncle has a bodyshop then take the details of the £650 garage to him and get him to phone them up and query the quote. He will surely know if the other bodyshop are 'at it' or the owner of the car is inflating it with other work.

If the other driver wants to continue and it is a 'scratch' then make sure you tell him he will have to 'declare' that he has been involved in a 'claim' on his own insurance for the next 5 years. It may not be an "own fault" claim but all future insurance companies will load his premium anyway.

Ensure you get his insurance details also so that when you go through your insurance his is notified also.

I Dunno. My mum's car that was grazed by a bus cost over £400 and that didn't look much. If an entire panel needs replaced and colourf matched, the costs can rack up.

A few years ago a neighbour pranged my car. He said he would pay for it, but being honest I said that I had already damaged it & so would have to have it repaired before it went back to the leasing company; we agreed to go halves.

He asked if I would take it to his brother-in-laws body shop who would do it at cost price; sure, say I.

I took it down & was given a quote of £250. But when I said that I would have to let my insurance company know as they would be paying my half of the cost he said "if it's going through an insurance company it's £650 then"

I told my neighbour that I wasn't having my insurance company ripped off by his brother-in-law so he would have to pay for it via his insuarnce company
