BMW 5 Series E60 - Tyre Failure - Warranty Claim - Aocal

Hi

Last year I fitted two run flat Dunlop SP Sports to the front of my 200 520D. The other day I noticed a crack inside the tread in an area of the tyre which is not in contact with the road in anyway. Closer inspection shows it runs all the way around both of the tyres. It's clearly a manufacturing fault from the Dunlop factory and therefore their 5 year warranty should kick in to offer replacements.

So, called up Dunlop and explained the situation and they said that to make any kind of warranty claim the tyres have to be sent to Germany for analysis!!! So I need to buy a set of new tyres and ask the garage fitting them to then post the tyres to Germany for me?!

Then, when Dunlop analyse them, if they agree they've failed they then measure the tread depth and offer me a percentage of compensation based on how much rubber was left. If Dunlop disagree they've failed then I have a choice of paying for the shipping back from Germany to the UK - kind of them huh?

I told them this was a disgraceful service and all they suggested was I take them back to where I bought them from (which is never going to happen as I bought them online.)

I also asked if I could take the tyre to a Hi-Q garage which they own for an assesment to be made while on the car and they said that's impossible, it has to be Germany.

They are making it as awkward as possible to submit a claim which I think is immoral & grossly unfair - hence me sharing what's happened with everyone reading.

You've got two options - go down the SoGA route and claim against the seller in the small claims court on the grounds of "unmerchantable quality" - or go down the manufacturers warranty route which is subject to their terms and conditions as these rights are additional to SoGA, not instead of.

As you bought them online, you're between a rock and a hard place - but that's your position.

Are you sure the crack is a serious problem?

I'd consult a tyre specialist before considering action.

Tyre claims have always been a strange area, years ago when i was involved, tyres that had failed were sent to the Bermuda Triangle like ''Tyre Manufacturers Conference'' as it was then called never usually to be seen or heard of again, it appears little has changed in the intervening 40 years.

Interesting car situation though, is the car suffering from heavy wear to the inside edges of the front tyres, maybe the forces causing the wear are causing the treads to split?

If so my MB does exactly the same (2 x Goodyear F1's starting to split as you describe), and reading many postings on my MB forum it appears many owners find the same problem with various tyre makes, i have this year bought some non directional summer tyres and will be rotating each season to help even the wear out.

My wheel alignments and suspension condition are as good as new, i can only put this wear situation down to the extremely good steering lock enjoyed by cars driven at the correct (rear) end, toy cars, FWD.;) don't have turning circles worth mentioning so maybe don't have this problem.....this isn't scientific or anything, just my observations.

You state that you bought the tyres that have an alleged fault online. If you used a credit card don't forget that you have Section 75 protection-in that the credit card company are jointly and severally liable for faults occurring with the product that they financed.

If the company that you bought the tyres from walks away from the claim, claim on the credit card company.

Thanks for all the replies, i've decided the hassle factor and the percentage of tread left on the tyre make it uneconomical for me to pursue this any further.

I just won't be buying any more Dunlop tyres after this, it's left a really bad taste in my mouth. Especially after I worked out that in the last 6 years i've driven just slightly less than 200,000 miles (in two cars) and i've been using Dunlop SP Sports for 90%+ of that mileage.

Yes I do think the crack is a serious problem, if I was involved in a high speed braking effort then i'm not sure what would happen to the tyre, it's obviously got a weakness which could be exploited during an emergency therefore I will have to get them changed. But yes I will take them to a good tyre dealer for a more professional opinion.

No the tyres are not sufferring from any excessive wear, it's all even.

I myself have always avoided buying Dunlop tyres. They have always been known for cracking, doesn't sound like anything has changed.

A friend of mine ordered a brand new car last year. He found out that one of the make of tyre this manufacturer would fit as standard was Dunlop. He made it very clear that to have the car fitted with these tyres would be quite unacceptable.

They took notice of what he said. His car was delivered shod with Toyos.
