Mazda RX-8 - Minor bump....need some advice please - londonman42

The missus was straightening up in the car park and as she slowly inched back a bit , she bumped into a car that was being driven very close to the line of parked cars. Looking at the damage caused to the other persons door and that done to our car...closing speed maybe 5 mph?, it looks very much like point damage that one would get if, say, someone had driven into her car door with a bumper corner or similar. Our car has no visible damage other than a slight scuffing of red paint.

So we think that the woman is trying it on and that the damage was pre-existing. Her car has a lot of other dings and dents all over it and she initially tried to tell my wife that she had broken the car wing mirror - which was a physical impossibility given the relative heights.

I went round to the womans' house and took some photographs and measurements ...you can see her damage here

Don't get me wrong, if we did cause all that damage then we'll step up to the plate.

But where do we go from here?

I've had a similar thing: I reversed into the car behind me; no damage to either car so we both drove away. That evening the husband phones saying there's damage to their car. We agreed to line them up in the same place like a Crimewatch Reconstruction. The new bump on their bonnet was an impossibility for my car to have made.

However, they claimed on their policy, the insurance company phoned me to get my side; I explained that I HAD dinked theirs, but explained as per above etc etc. The result was no loss to me because insurance companies hate people trying it on and if you're honest as poss with them they'll help you out.

I'd suggest (being an armchair loss-adjuster of course!) that the damage on the Corsa is consistent with the horizontal rub-line along the bumper of the RX-8.

Some guy ran into the back of my wife's old CRV at perhaps 5-10mph at a roundabout.

£1500+ for repairs.

The rubline on the RX8 is where I rubbed the dirt off with my hand. There is a slight amount of red paint scuffed there but the height of this is 4" higher than the damage on the other car.

If you can take more photos I would suggest doing it with a ruler showing the relevant heights of damage as that would help your case that the ding by the door bumper strip is the wrong height for your rear damage.

You are going to have a fault claim in any event. If you are planning to self insure (ie cover the damage without recourse to insurance) then you clearly need to resolve what damage you are going to repair.

If you are not and plan to progress via insurance then you should obviously tip them off but whether a long argument over what damage was caused will not make much (if any) difference to your claims record or no claims bonus as it will be entered as a "fault claim (minor damage)".

The photos show what you said earlier quite nicely, that the damage caused by your car is lower than the big ding in the door.

Can you persuade the other party of that and get them to accept a sum in lieu of damage?

I don't think these two photos look like the two ends of the same collision.

If the Mazda had gone faster it could have dented the Corsa to the same depth but the damage would have been wider.

Obvious.
