Admission of Liability - Steveyp

Hi Lucy. I was involved in a minor accident last November. The third party insurers admitted liability on the phone the next day. Approx 1 month later my insurance company informed me that the third party had raised the question of liability. The third party then paid, without prejudice, my hire car and repair costs. The question of liability is still outstanding a year on. If this went to court, would the initial admission of liability, then change of mind have any bearing on the case ?

The answer is yes it would have a bearing on the case but an initial admission is not necessarily binding if additional evidence or information turns up which would justify a change of view.
