i was riding my moped on a main road early yesterday morning when i suddenly lost control (like slipping on ice) and then crashed through a hedge wrecking my bike and breaking my arm.

The police came and breathalysed me (totally clear) and said that there was a hGV yard up the road and i should take legal advice regarding being injured. i asked them how i could claim when there was nobody else around but they just said they couldnt tell me anything as they were the police and i needed to take my own advice.

my mum spoke to a solicitor from our village yesterday who said i could claim on my insurance for the damage to the bike not for the arm but then said i cant claim for the motorcycle damage as i am only third partly insured.

The insurance would cover the cost of the damage to the hedge and that was it.

my insurer say's the same. i cant claim for the injury as there was nobody else involved and so it must have been my fault but i should get the farmer to contact them about fixing his fence.

i tried a no-win-no-fee solicitor who advertise on the television and they confirmed i dont have a claim.

i am totally busted financially at the moment but will need to get a new bike for work.

does plod know something no-one else does regarding insurance or am i totally on my own?

i think that they were suggesting that you slipped on spilt diesel from an over filled tank of a hGV from the depot. Unfortunately you won't be able to prove this.

That helps me get started boris thanks as everyone else has been totally useless so far but what evidence would i need to get if i did have a claim.

i guess i need to know who wass driving but there cant be many people working their on a sunday at six in the morning except i think there may be more than one firm uses the yard so i guess that would stuff my case?

You don't need to know who was driving or even the firm they worked for.

The place to start is the police. Did they check the road at the accident scene? if there was a lot of diesel (i mean a lot) on the road then you have a starting point unless you have a diesel powered bike ;-) but you won't get anywhere without a police report supporting you as to that was why you came off.

Squeezebox is right - the key is the Mib untraced driver's scheme but there must be an injury and there has to be evidence to support the fact that your collision occurred as the result of a diesel spill.

that said you don't need to identify the lorry or the company concerned and it does not matter whether you were in proximity to a place with an hGV operator's licence - although it obviously helps.

however you will need a competent and persistent lawyer to succeed in bringing any claim for a slip on diesel and you may struggle to find one who might undertake a marginal case on a no-win-no-fee basis.
