Hi this is my first post and was just wondering if anyone had any advice.
In December I bought a brand new Suzuki Alto, at 42 I have never had a brand new car before and this was my pride and joy, I had saved hard and used my 10 year old Nissan Micra (under scrappage deal) to be able to afford car. Obviously it then snowed, and snowed and snowed so in fact I had only driven the car for approx. 3 weeks, the rest of the time it's sat on my drive nice and safe.
On Monday this week, no snow, no ice, decided I would take my new car out, that's when a Mitsubishi Shogun decided to plough into the back of me!!. Obvioulsy I had a huge amount of damaged, and if it hadn't been for the spare type in the boot, the dog would have been crushed.
Luckily police were passing at the time and the Shogun's driver admitted full liability. My car was undriveable. Having been taken by insurance companies garage they have now confirmed that they will be repairing the car.
Is there any way that I can contest this. The car has not even done 260 miles, and I don't want a brand new car back that I know has been in a major accident. I've been told that the insurance company will go upto 50% of the value of the car before they write it off, seeing what damage the Shogun has done I would be very surprised if the car can be repaired for £4000 can anyone help.

Claim off 3rd party rather than your own Ins Co - they may take a different view. They can buy @ big discounts and might look upon problem differently.
Cost of repair+Hire Car+Loss of car value (claim for this)- it can take months sometimes to source parts so the hire bill could be substantial!
Shogun up the back - has the car been checked for alignment?

I am waiting to speak to the estimator on Monday, who apparently will detail all the repair costs. Do you know how I would get hold of the 3rd Party details, would that be thru my insurance company, or should I ring up the Shogun's driver direct and ask for her insurance details? Never been in this situation before.
Courtesy Car ! That has been another complete headache, because of the snow and ice, the garage didn't have any cars available, they therefore hire you a car, I have now had to take on a £250 excess liability, when my insurance is £150 tried to argue that fact with them, but they wouldn't budge, don't see why I should have to take on a larger liability when accident was not my fault !

i would be very surprised if this car was repaired
if as you say the rear floor is crumpled then its a lot of work to fix plus the time factor in getting this panel plus everything else smashed really should make it a write off
why dont you consider someone like helphire to fight your corner and also as the accident wasnt your fault they will sort you a hire car out for free and knock sense into the insurer-s

I suggest you check your insurance to see if you have legal assistance. I have found a service of this type to be very helpful on the two occasions I have needed to use it.

Perhaps I'm being naive here, but every insurance policy I've had offers a brand new replacement vehicle if a new car is written off in the first year. So if yours does too then you actively want it to be written off!
Or maybe not all policies do this?
