Ok guys
This is again a kind of backwards one, in so much as i am the seller, who bought the vehicle almost 2 yrs ago, having now outgrown it, we need to sell, to release funds for a larger one, so we duly place ads in respective places, buyer contacts us and a can of worms is opened......

Prospective buyer gets Hpi check done...which i didnt bother with when i bought it as the vehicle is a conversion bought from another member on a well known forum group for these vehicles, [its not easy without naming people stick with me though] i had absolutely no reason to disbelive what my seller told me so no reason to HPI it, all mots back to 2006 were in order as was mileage on the vehicle.....we have had not one issue with it since buying it and it has undergone numerous Mot's [2] and services at main dealers...

SO firstly HPI check comes back with mileage in 2005-06 of wait for it 840k and no records since until now at 99.500k ?? befor ethe 840k however it seems correct going from 2001-2005-6 and ending at 125k all additions seems plausable withy 4k-6k each time which would be usual i would of thought, however ignoring the 840k as HPI/mileage check immediately removed that figure which according to their records meant the vehicle had covered 700k in 6 months which apart from being ridiculous was nearly impossible...

We still however have a mileage reading of 125k back in 2006-07 which is when this vehicle was being converted by a well known conversion company, i have been on to the person who sold me the vehicle, who swears by the 91k he sold me it at the old Mot's bear that out as does his receipt, i have been onto the convertor, who says not a lot, apart from it was never "the" companies vehicle but ratyher the owners fathers so never went through the company, so they would have no receipts no records rather convieniently, not withstanding the fat there was a 5 page write up about this very vehicle in a well known marque magazine stating the vehicle was the conversion companies demonstrator for sometime, and several other things in contavention of what the convertor has told me.....who, what do i do know

The sum total is that, i will effectively be now selling a vehicle with 99.500k on thye speedo, but that had done 12k back in 2006 and goodness only knows what inbetween i know i have done about 8k ish the previous owner the same ish so thats 16k plus whatever the conversion company did in it which could potentially be quite high as it was shown at several trade and marque shows assuming he did teh sam eas my seller and i have that would make it be another 24k making the mileage 150k and devaluing my vehicle by about 1/2, who do i go after the guy who sold me it, the convertor who owned the vehicle at or about the time the vehicle was quite clearly tampered with or what???

Also am i breaking any law by selling her at 99.500k and not admitting to the HPI check which i am aware of, although not instigated by myself, as my buyer has pulled out now to look elsewhere, leaving me in a quandry as to what to do now...

Any and all help appriciated please the vehicle is still actively advertised a buyer is supposed to be veiwing and potentially buying this comong weekend

The 840k was proably supposed to be 84k, an error, you could contact HPI.

Or simply say to buyers that HPI mileage check shows 840k which must be erroneous beacuse it would mean that the vehicle had covered 700k in 6 months, impossible.

The 840k has been accepted as an error and removed by HPI. The problem is that it is recorded as having done 125k (incorrectly typed I think as 12k above) in 2006.

The whole original post, if I understand it properly, can be summed up as -

"I've a vehicle showing 99,500 miles, but I know it had 125,000 miles in 2006, so the mileage is a lot higher than shown.

I have no way of knowing who clocked it.

1. Now that I know about it, can I keep quiet when I sell it?

2. Have I any redress against the person who sold it to me, or the person who sold it to him?"

OP, I think you should take your car off the market just now and maybe consult Citizens advice or someone similar. You are now knowingly selling a car with an incorrect mileage.
And admitting that on a public forum.

Nothing at all, but recently we seem to have had a spate of one-time only posters involved in an unlikely set of circumstances involving all sorts of complex legal issues.

It is difficult not to become a bit cynical after a while.

In regards to advertising the car, having lost one seller due to the HPI check, and with a lot of national advertisers linking to car checking services it could be a massive gamble not disclosing the true mileage of the car.

Without going into the ethical and moral issues of misrepresenting the car for sale, you have now posted this information on a public website, so potentially have provided evidence of knowingly misrepresenting the vehicle. Also bear in mind any future owner may also speak to the company that carried out the work who could mention the mileage issues.

Incidentally using the information provided I have tried to locate the ad myself to see if it is easily identifiable, and have found one that seems to tally. I won't go into details, but will say I think you have left yourself no choice but to be honest about the mileage.

Unfortunately I think it will be an uphill struggle to prove who clocked the mileage, and will be the word of the person you bought from against the company who did the work. Did the person you bought from own it before the conversion work was done?

hi, im a little confused by your post,what type of vehicle did you buy,vw what?is it customised?whats the conversion you mention.
As to the mileage issue its a criminal,as well as a civil,offense to offer a vehicle for sale thats showing an incorrect mileage,you must disclose what you beleive to be the correct mileage on the car.if you manage to sell it make sure the buyer signs an indemnity,that says the mileage on the car is incorrect.
as to pursuing the person /dealer who sold you the car,its unlikely that police / trading standards would involve themselves in a purchase that took place two years ago.They will only get involved if evidence of persistant clocking can be found.
One more thing to consider .you appear to suggest the cars value is only 50% of what it would be if the mileage was correct. you appear to have bought a car thats showing 100K thats actually done 150K .If the car is more than 7 or 8 years old, the actual value would have been quite low.50% of a low value is how much ? Its likely that a large part of its value is in its conversion,customising,So how much money have you actually lost .
Finally you may be able to sell your car via a car auction ,just make sure you dont guarantee the cars mileage on the entry form ,then you have no legal comeback .Always always hpi a car before buying,The RAC website will do a full hpi including the finance register for £10 or less,
